Good day!

4 po magkakapatid sila daddy. bumili po ng lupa tita ko sa sarili nyang pera tapos po pinangalan sa daddy ko yung lupa. namatay na po ngayon tita ko. may habol po ba yung ibang mga kapatid nya sa lupa kasi sa pera ni tita nanggaling yung pambili pero nakapangalan talaga sa daddy ko?

Hello.
Legally, kung nakapa ngalan sa daddy mo yung lupa, it will be considered as his property in the eyes of the law. Meaning, wala nang habol ang mga kapatid niya.
Morally, however, since your dad knows that the property is not really his, he must give the same to the legal heirs of your tita.

TCT lang po named kay dad. yun lang po. ang sabi daw po kasi nung mga kapatid nya, alam nila pera ng tita ko ginamit. yung ibang property po, hati hati sila based sa last will. pero di nakalagay sa last will ng tita ko yung property ni dad kasi po nakapangalan talaga kay dad and binigay talaga ng tita ko sa kanya.

hmm, in that case, baka considered na nga yan as share ng dad mo sa estate ng tita mo. heads up lang, baka singilin dad mo ng donor's tax na ichacharge sa estate ng tita mo.

naayos na po nila yung estate ni tita. kapag ganun po ba considered pa rin na property ni tita yun kasi may donor's tax? tinitignan pa po ba ng law kung sino talaga nagbayad ng property or kahit sino nagbayad basta nakapangalan sayo, iyo yung property?

yung ibang properties po kasi ni tita na transferred na po sa named ng mga magkakapatid including dad. 3years ago pa po namatay si tita. ngayon po kasi nakapagsalita yung isang tito ko na dapat may hati sila property ni dad kasi si tita nga daw po nagbayad. pano po yung probated?
