Fifteen years ago, my dad went abroad while my mom's still pregant with my sister. We never heard anything from him ever again. We were fine that way, we lived in our Lolo's house(mother side), we could buy stuffs we need. Everything flowed smoothly with my mom's siblings supporting us. But during my 2nd year in College, hell broke loose. They can no longer support my studies, so does my sister's. So I stopped in College and I just don't know what to do. Being 18 and undergrad, it's hard to find an average paying job in the province. We're really desperate, it doesn't show with my mom but I know that she is.

Eventually, I found a job(it pays less than the average)But the thing is, we still can't afford to support my sister's schooling(my mom's salary and mine combined), can we still "make" my father to support us? Because we tried communicating with him(his siblings) through Facebook but we only got seenzoned, got blocked. I think they even deactivated their old accounts, created new ones and changed their names. Mom and dad are married. And I heard that dad has a new wife, and also got their children. They live here in the PH. What can we do to make my dad support us?

Is your sister still a minor? if yes then your mother can file a claim for support. If they are legally married, then your mother owns half the property your father's has. It can be used also for support. I suggest you hire a lawyer for that.

As legal wife, your mother has rights to receive spousal support based on your statements. She has rights to file RA9262 case (for non-support and abuse etc). Possible concubinage and bigamy cases against your father as long as she can be prove them in court and it is her intent to do so. Jail term and bailable.

As legal dependent of your father, based on your story, you and your sister also have rights to receive financial support from your father to sustain food, dwelling, clothing, education, transpo meds expenses needs. Your prayers for education or career training are part of them. RA9262 cases can cover non-support issue inside court that is. No fixed rate on financial support, court will decide on that.

Hire a private lawyer or visit the nearest PAO in your place if you do not have one yet. They can give you legal advise and possibly how to proceed if you are an indigent.

Thanks for the advices.

But what if we do not know where exactly my father's current location? And Would it be better if I'd be the one filling a case instead of my mom?

There is no wrong if you file the case but it is better that it's your mom who files the case so that you will not get only your support but also ur mom's.

If you dont know the address, the court will do find him. Just file a case.
