Please, we really and desperately need your help. As of the moment our counsel is not answering our calls. Hereunder are the antecedents:
My tito was convicted on Sep 6 2012 for violation of Dangerous Drugs Act. A timely motion for reconsideration was filed by our counsel before the 15-day period for its filing expired.
On October 22, we received a copy of the answer of the prosecutor.
In December and January 2013 we asked the counsel if he had already received a copy of the resolution of our MR. He said there was none.
Tonight, February 21, 2013, my tito (who is now at bilibid) received a copy of the NOTICE OF FINALITY OF JUDGEMENT. It was stated therein that the RTC had already dismissed the MR on November 5, 2012 and that by reason of our failure to file an appeal, the judgement has become final by November 20, 2012.
Please, we do not know what to do. I still have not talked to our counsel on whether he received a copy of the MR.
Assuming that there was indeed no notice to the counsel, what are our remedies. God bless you ma'am or sir who will answer this quesry/
