good day po....

MY anak po ako.... outside marriage.... when i gave birth ayaw ipagamit ng parents ko ung surname ng father ng babay ko. because madami din kc anak ung bf ko sa ibat ibang babae..... hindi din naman sya tumutol na hnd gamitin ung lastname nya (my BF)....

pwede ko ba sya i obligahin na suportahan ang baby ko?

if ever po ba may case ako na pwede isampa sa kanya?

ung iba nya kasing anak sinosoportahan nya pero ung anak ko ni singko wala man lang sya binigay.....

Hi,

You can oblige the father to give financial support to your child by sending a demand letter to him. If he refuses to give financial support, you can file a civil action for child support or criminal complaint for economic abuse if you have evidence that the father has acknowledged your child. If not and he refuses to acknowledge your child, you will have to prove that he is the real father in other ways like DNA test.

Good day ms. Katrina,

May I ask what kind of evidence should i have to file a civil action for child support or criminal complaint for economic abuse?

If I use DNA result to file a case against him what would be the consequences on his part? will it put him in jail?

You will have to submit the birth certificate of the child, including the acknowledgment by the father, and available receipts for the expenses. If he has not acknowledged your child (by signing on the birth certificate or executing an affidavit acknowledging your child), then you will have to prove it by DNA testing. If you're able to show that he has not been providing support to your child, you may enter into a compromise agreement (if he agrees to provide support, etc.), and if not, he will be imprisoned.
