What will be the legal basis for issuing suspension for an AWOL employee who eventually acquired employment to other agency without being cleared from his previous employer?

hindi yata pwede i-suspend ang isang tao na hindi na empleyado, lalo na kung na-terminate dahil nag AWOL.
