Hello

My son works with one of the major telecom companies but only through an agency. He's 1 year, contractual, assigned in a business center located in a mall.

One of his co-employees who was already terminated was suspected to have carried off or stolen some iPhone units from the store which, based on my assumption happened on a holiday when my son did not work, he being on leave.

A so-called investigation was conducted by the company. It took time before a decision surfaced and the other employees who report to that branch got the surprise of their life-- they are now being asked to shoulder the cost of the lost items and teamwork is being laid on the table as a ruse to get their support and agreement.

My son has indicated that he won't agree to it for obvious reasons. He assumes he was not there when it happened and the manager of the store who came in that day did not cause for an inventory of the items to be reckoned that very day and the day after. Secondly, this company has the reputation not to action employee needs for regularization specifically for those hired under an agency. Therefore my son has been with them for over a year but still of a contractual status.

When the manager had realized that my son is not in agreement with what she was proposing, the manager had said that he (my son) can resign but the company WOULD NOT ISSUE A CLEARANCE.

Does this have any legal foundation? What can my son do? Can he file a case with your department? How do we go and raise it with NLRC?

Please advise us soonest. Thank you kindly.
