NSO refused to issue my Marriage certificate

i had my second marriage last year. so now, i am trying to get my copy of marriage cert in NSO but they gave me the copy of my first marriage, khit saan aq mgrequest ganun ang ngyyre. ang sabi nila, kelangan dw mgbgay pa aq ng death cert ng ex ko or anullment paper. to be honest, hindi ko din alam kung buhay pa ba or kung asan na ung ex ko. he is a foreigner, and kung sakali mang patay na xa, mahihirapan din kame to confirm or magpa authenticate khit mkahanap pa kme ng docs dhil wala nman clang embassy dito. nakakapagtaka nman ang ruling na ito ng nso. do they have the right to investigate? in the first place, kung my kaso man dun e d kame na ang bahala dun hindi cla. May nakaexperience din ba sa inyo ng ganito?

actually xa ung una nagrequest dun sa quezon city branch. ayaw irelease.. then cnubukan nmen mgrequest online dun sa nso helpline. same thing happen. ung first marriage ko ang ibinibigay. sobrang sakit sa ulo ksi mgchuchurch wedding pa nman kme at need nmen nso copy nung marriage cert nmen. iniinsist nila mgpasa kme documents pra maverify dw nila. DOJ na ba ang NSO ngaun?

problema pa ngaun ksi nagdeclare na din xa sa office nila na married na xa,. anu ngaun ippresent nya na nso copy ng marriage cert nmen. hnd nman ksi tinatanggap ung original from local civil registry.

I believe the best course of action for you is declaration of presumptive death for your previous husband.
sa pagkakatanda ko if 4 years (2 years if may risk of death like nagbabarko) ng walang contact sa kanya at tingin mo patay na sya ay pwede mo na ito file sa korte. eto yung requirements sa presumptive death

The Essential Requisites for the Declaration of Presumptive Death Under Article 41 of the Family Code
Before a judicial declaration of presumptive death can be obtained, it must be shown that the prior spouse had been absent for four consecutive years and the present spouse had a well-founded belief that the prior spouse was already dead. Under Article 41 of the Family Code, there are four (4) essential requisites for the declaration of presumptive death:

1. That the absent spouse has been missing for four consecutive years, or two consecutive years if the disappearance occurred where there is danger of death under the circumstances laid down in Article 391, Civil Code;
2. That the present spouse wishes to remarry;
3. That the present spouse has a well-founded belief that the absentee is dead; and
4. That the present spouse files a summary proceeding for the declaration of presumptive death of the absentee. wrote:

madali lng ba mag file ng presumption of death? 2 yrs ago, kumuha ako ng lawyer to file anullment, in the first yr wla ngyare, on the 2nd yr halos dun p lng nagcmula dhil sa dameng alibi,. khit inis na inis ako sa lawyer na un, hnd ako nagsalita hoping maawa nman xa dhil out of the 200k na fee nya, 170k ang nabayaran n nmen dhil nagkasundo kme mgbyad monthly. then last yr, he advise n kung ngmamadali dw kme, mg subsequent marriage n lng dw. thru his help naikasal nga kme. pumayag aq iwithdraw nya n lng case since napasok n nman dw sa NSO ung marriage nmen. then eto ngkaproblema. now cnsb ko s knya na ituloy n lng anullment pero i dont feel like he is willing to continue anything. sabi pa my friend dw xa na na grant ung anullment pero na reverse sa court of appeals. nagsuggest xa ngaun na presumption of death. im asking him kung anu mga steps, clarifying mga bagay na nabasa ko. but then sinungitan pa aq as if ang dating nagmamagaling ako. wala n tlga ko tiwala sa knya.. nkakalungkot dhil we are trying to make things right, gumastos ng napakalaki khit d nman kalakihan ang sweldo. pinaghirapan nmen bawat sentimo na ibinayad sa knya pero wala ngyare. mas naipit pa kme sa sitwasyon ngaun :'(

kung magfafile ba q ng presumption of death anu magiging effect nun sa 2nd marriage ko? we have been fighting for this for so long. nakakafrustrate na. i admit i made a mistake when i was younger. theres nothing i can do about it now but to move on. i want to make things right kaso bt my mga ganung lawyer. wala man lng concern. sa una lang magpapakita ng kabaitan. after mo magbayad wala na. porket alam nilang lawyer cla hnd cla pwde ireklamo? khit gsto ko man gwin un i dont have the resources na. and ayoko din magbackfire sken pg nagreklamo pa q.

Seems to me that your 2nd marriage is void and null unless annulment or presumption of death was declared final by court before your 2nd marriage.

Getting another lawyer to proceed with presumption of death case before any other church or civil wedding, could be a good move for you.

find a reliable lawyer na matutulungan ka sa pagfile ng presumption of death. ang alam ko may fb group na pro divorce something. magpost ka dun. maybe may mga members dun na maituturo ka sa tamang tao. pwede mo din antayin na may magpost dito na abogado.
regarding sa validity of your marriage, I guess the proper term is voidable yung 2nd marriage nyo since it does not comply with the pre-requisites of a valid marriage.

para sa simbahan. ksi gusto nmen magpakasal sana sa church..

my nkausap akong lawyer kahapon, ang sabi nya dpt dw anullment tlga. kung mgfile ksi aq POD mauuna pa din marriage nmen compared sa decision kung sakaling magrant man ung POD. compared to anullment, magkakaron ng anotation dun sa MC ng unang marriage kaya pwde na ko makakuha ng MC nmen for my 2nd marriage.

my idea ba kau whats the difference nung nso issued MC compared sa MC printed in SECPA ? someone told me na pwde dw gawin un. kso iba ang pipirma, hnd ung lisa grace bersales. is it also valid? ang mahal ksi dhil sa BSP p dw kukunin ung papel nun.

thanks po pla sir marlo and sir xtianjames sa mga response and for not judging. ang bigat bigat lng ksi sa loob na nauwi sa wala ung perang ibinayad nmen. wala nman kame napala. naging complicated pa lalo. due to my frustrations sa lawyer ko, kumagat ako sa suggestion nya which is wrong on my part. stress na stress na din ksi ako sa knya na after nung mga bayad nmen ang siste patuloy pa din xang hingi ng hingi kung gusto dw nmen bumilis ung proseso. wala nman kme assurance na mapapabilis tlga at buti sana kung pinupulot lng nmen ung pera na binabayad sa knya. hindi ko na alam kung my mapagkakatiwalaan pa ba aqng lawyer. ksi ang hirap dhil lahat sa una mabait, pg nkabayad na parang binabalewala ka na.
