my husband had a accident work related.
Equipment has a history of defective malfunction resulted to blast function of the machine to be shut off july this year resulted to injury of the employee of that said machine. The Head Engineer was reminded by husband to ask for a replacement of that circuit breaker but ignored it.
Nov 7,2015 they have an operation to check the generator so they need to shut the power supply my husband ask the engineer is it ok to use that machine which has a history of blast my husband is doubtful to do the action off shutting off but the Engineer gave him an assurance that the contractor verbally told it was ok for operation,
Unfortunately accident happened resulted a partial thickness burn 7.5%
on his left arms which had the severe burn wound and right arm, he is lefthanded the concentration of arc flash on his left arm and hand.
Compensated for his injury with the company that he works recieved 20K and that was it.All of our expenses came from our pocket his SSS was delayed due to reports that the building naturw of accident immediately accomplished.
We complied their requirements and incidental report.
practical reason we thought the contractor was liable for my husbands injury asking for damages.
Since the accident his engineer never mind us or bother to know the condition of my husband til we demand to meet the contractor that meeting i burst in tears begged for help for we are full of debts but that meeting almost put us to devastation they told us upon their investigation they blamed it to my husband as human error which all along my husband was not informed if that report to justify himself that he just follow the command of his Superior (Engr.) No defense from the Engr. building manager that he was innocent sad part they can not pay us.We ate our pride if they can help us with our expenses 30k agreed to be payed by staggard basis but refused to sign for that agreement.We text and called the given number no reply.

kami laging naghahabol sa knila pero walang tulong nagmukha kaming tanga sa meeting na yun literal iniwan kami sa kawalan kami na nga ang nasaktan inapakan, hirap,pasakit,nahamak at sabihan ng mgr ng contractor wala daw kaming laban kasi talunan kmi nung mag breakdown ako sa harap nila poker face lang at sabihan ka sanay na kami sa ganyan.
Hindi tao kaharap ko wala silang awa sa angyari sa amin.
Umabot kami sa dept of labor to complain for his medical assistance sa company the Head of HR was surprised of the damaged inflicted to my husband he was not able to work he is still recuperating to ask for assistance with the owner because they are not aware of the severity of the accident another 10k would be granted to us as settlement at DOLE on tues.
Is that his fault??
