I have started a Poultry Business in La Union last year. Come 2015, I had to move to a larger poultry house and paid 12,000pesos downpayment to the landlord. I also paid 35,000pesos to the people who said they would supply me with one-day old chicks and poultry feeds.

After, a month of the downpayment. I went back to La Union to start the business, however, the Poultry House I paid downpayment for was being renovated by the people I paid 35,000pesos to and the Landlord said that I was too slow in taking action that he my downpayment of 12,000pesos is consummated already. In short, the poultry house was not to be used by me as rights were given by the landlord to the supplier to run the poultry house. I packed up, all my things the next day and went back to manila with an angry and broken heart.

I later found out that they also did the same to a couple but amounting to 90,000pesos.

Question:

What can I file against these people? Sure, 35,000+12,000 is difficult but I can earn that. I would like to sue them and also want them to pay damages because my time and effort to-and-fro La Union is not easy. My family was also devastated because we are now in debt because the Poultry Business didn't run after collateraling some things we had to bear capital.

I'd appreciate any help and I am serious about suing them. If you'd like to assist me out, i'd like to visit your office. Thank you!

The 35 000 is fraud. (Why did you pay in advance and not at delivery??)

Some unclear about the property if it's wrong too or legal.
DOWNPAYMENT to BUY the property
or DEPOSIT to RENT the house?
When were you suppoused to get access to the house (I mean how many days before you arrived?)
And when werre you suppoused to pay the rest of the buy/first rent?

"I later found out that they also did the same to a couple but amounting to 90,000pesos. "
You can file case TOGETHER with them and share lawyer to reduce the cost.

In a case you can claim "anything". Then it's up to the decision what you get entitled to.

Hi Lunkan, thanks for your reply.  Smile

The 35,000pesos I paid for the chicks was a downpayment. The total worth of chicks I was supposed to purchase was around 50,000pesos. Was supposed to deposit another 15,000 but I had to go back to manila for some personal matters so 35,000 was all I paid. The downpayment will get me around 2000 chicks and the supplier will finance the other 1000 chicks which will give me a total of 3000 heads to take care of, hence them asking for a DP.

As with the property, I paid 12,000pesos deposit(a month's rent) to secure the place. The house had been vacant for years and as soon as I paid the landlord, I was allowed to renovate the place - which I did, but there were still some things left unfixed, until the time where I came back and the owner gave it to the other party. I haven't started any poultry cycles yet in that house. Which leads me, can I get my 12,000 back? It clearly can't be consummated since it wasn't used, it was a deposit which I think SHOULD BE consumable, however like I said, my cycle hasn't even started yet and I got screwed.

I'll be in touch with the couple who got scammed too, I just want to hear some advice regarding my course of actions first.

Do you have an office in Manila?  Smile

Oh that PERHAPS change the matter to NOT fraud.
Didn't you pay the missing 15 000p IN TIME?

"can I get my 12,000 back? It clearly can't be consummated since it wasn't used"
Well. WHEN were you suppoused to start paying RENT?
Did you start paying rent in time?
Tennants have some rights, BUT if you didn't pay the first RENT in time, then it's questionable if you ever were started counted as tennant in legal point of view.

"it was a deposit which I think SHOULD BE consumable,"
No. Deposites are SECURITY, whiich the OWNER can TAKE sometimes, IF the deal isn't followed enough. (For instance damage something or not do something IN TIME.)

That's why I ask if you MISSED to do something IN TIME according to your agreement. Such risk make what they did is LEGAL. (Check with the other couple too, if they did all in time.)

"Do you have an office in Manila?"
No I don't like cities. I have my office in forest in Sweden haha planning to start business RURAL in the Philippines. (Some other main business as for instance forestry, but perhaps adding chickens under the trees Smile
