Good day Atty, I need your legal advice regarding “annulment” my wife filed a nullity of marriage at pasay city court, the grounds is psychological incapacitate, on Dec13, 2010 I receive a summon for the annulment. Do I need to answer this summon? I just want set her free. If I answer the summon letter it will speed-up the process of annulment or not? Thank you

thanks atty, I am the one who will be psychological incapacitated, i think i dont need the psychologist examination they already made it up, they have a friend which is a psychologist working at NBI, they already have my diagnostic impression attached to the summon, i think this is what they called package annulment. But i notice this quote on the front page "If you fail to answer within the time fixed, the plaintiff will take judgment by default and may be granted the relief applied for in the Complaint" Did this means that they will consider me as psychological incapacitated, which is good for the annulment! or am i wrong! dont know what to do. thank you and have a prosperous new year

i abhor these package deals, but i have to recognize they are the norm. i recommend you just leave it be so you don't have to be part of what they are doing.

you can go to the pre-trial, but please don't lie if the judge asks you a question.
