Hi guys kindly give me some advice if i can do something about my problem.

in my contract it says 6 months notice period daw failure to do so kelangan ko mag bayad ng 6 months equivalent sa salary ko.

nag resign ako ng immediate mga 9 days lang notice ko pero ginagawa ko naman ng maayos ung turnover ko. at pumayag naman na ung company kaso parang pababayarin pako dun sa 6 months notice.

pwede bako matulungan ng dole dito?

Teka, wala pa namang demanda sayo na magbayad ka di ba? Bakit ka nag-iisip na pupunta agad sa DOLE?

Anyways, if the employer opts to claim 'payments' from you, by all means, they have the right to file and claim but they don't have any basis to claim.

To protect yourself, do the ff;
1. Get another copy of your submitted resignation Letter with the signature of your superiors/officers;
2. After getting a copy, process your clearance, COE and backpay ASAP.

Hi hr dude,

I just want to seek advice sana sa dole if legal ba yung 6 months notice nila? Kasi diba parang napaka tagal?

Ang sabi sakin kasi wala na daw ako backpay makukuha ni 13th month kasi ibabawas daw dun sa 6months notice ko na dapat ko raw bayaran base dun sa contract.

Nasa kontrata mo yun at pumayag ka. So unless proven that it is illegal in nature, you should comply with it.

The MINIMUM requirement ng labor code is 30 days notice. And dun pa lang mismo hindi mo na rin natupad.

Wala ba magagawa dole para atleast mabawasan manlang yung babayaran?

baka matulungan ka ng dole kung ireklamo mo yung kumpanya at kung manalo ka.

kung gusto mong mabawasan ang babayaran mo, siguro dapat mo muna kausapin ang kumpanya para makipag-areglo.

Gusto ko sana as much as possible na wala nako babayaran since kahit na di ko nirender yung 6 months or 1 month ginawa ko ng maayos ung pag turn over. Isa sa dahilan ko di ako binigyan increase sa 2 yrs kong nag ttrabaho sakanila, then malayo pa sa field ko ung pinapagawa nila. May chance kaya ako manalo?

Manalo? Manalo saan? Hindi ka naman dinedemanda o hinihingan ng bayad. Hindi ka naman nagdemanda laban sa kumpanya mo para saan yung sinasabi mong 'mananalo'. I-process mo na lang yung clearance mo, that way may panlaban ka kung sisingilin ka.

Meron. "Upon successful completion of the probationary period your gross salary will be revised based on your performance" imposible naman sa 2yrs di ko napatunayan yung skills ko sakanila given the fact na magagawa ko lahat ng task nila na binabato sakin.

Im just saying if ever bang mag reklamo ako sa dole and kung idemand nila na bayaran ko yun sinasabi nila na 6 months notice. Eh may pag asa manalo if ever lang naman. Napa sign ko na resignation letter ko pero may note nilagay: "see email from xxx for terms" yung coe at bir baka after a month daw nila ibigay pag clear nako dun sa issue na notice period

Kung itutuloy ang demanda sayo, isipin mo na my karapatan sila. Isipin mona lng kung paano mo mababawasan yung singil nila.
