Hi, I am new here. I am an online seller at nagkaproblema ako shipping. Nagpaship kasi ako sa Fastrack (na regular ko nang courier) pro first time ko magpadala ng luggage sa kanila. Sample lang sana yun pra sa buyer ko na kukuha sana ng hindi bababa sa 10. Sa kasamaang palad, pagdating sa buyer, dumating na sira. Ipinack ko lang sya ng black plastic and packaging tape (gaya ng ginagawa ko sa twing magpapadala ako ng luggage sa jrs). Nung nireklamo ko, ang sabi sa akin ay ito...

Dear Ms. XXXX
We write in relation to your demand for replacement of the Hello Kitty mini luggage (“Subject Item”) subject of Waybill No. XXXX you sent through us to XXXX (“Consignee”).
You claim that the Package you sent was intact and that the damage caused to the Subject Item’s body was due to our fault/negligence, thus you claim for replacement of the Subject Item.
However, we delivered the Subject Item in the same condition to the Consignee as we received the same from your supplier XXX without your presence which the item was not properly packed with bubble wrap or boxed. We fully performed our duties with proper diligence required by law and committed no fault nor negligence as would cause any damage to the Subject Item if it was packed properly. In fact, you were even unable to show that the package as received by the Consignee was tampered, upon Consignee’s receipt of the Subject Item, much less prove that we caused said damage to the Subject Item.
Moreover, in signing our Waybill No. XXX, you agreed to the terms and conditions of the same, which includes, among others, that we will be liable for any proved damage on the Subject Item, provided that the value of the same is declared. You did not, however, declare any value on your Subject Item, which thus further prevents you from holding us liable for the same.
In this regard, we wish to inform you that we cannot accede to your demand for payment and/or replacement of the Subject Item, there being no legal nor factual basis for the same.
Consequently, we are tendering its return to you.
