need help po..

since birth po, ginagamit kong name is hindi pala ung name sa birth certificate ko.. last year ko lang nlaman na adopted ako. pano po ito? pwede ko bang ipalate register ung name na ginamit ko kasi nandun lahat ng educational records ko? o pano ko po ipapalipat lhat nmg records ko sa real and registered name ko?

Were you legally adopted? If not, you cannot use the surname of your adopter.
If you were legally adopted, the approval of the petition for adoption normally comes with a court order directing the Civil Registrar to make the neccessary changes in the birth record of the adopted child.

If you really want to make these changes in your birth record, you would need a lawyer because it needs a court order. But that will entail the filing of a petition in court. After having established your case, the Judge will issue a court order directing the civil Registrar concerned to make the neccessary corrections.

How about changing your other records to conform with your birth certificate? I think this is much easier because you will only be required to submit an affidavit explaining why there has been a discrepancy between your birth certificate and your other records. Here, no court petition is needed since you are not changing an entry in your birth record.

i agree it may be better to just try to change the records rather than the birth certificate.

Hahaha! Talk about serendipity. I finished my Bachelor of Laws from the University of San Carlos and I had my school records changed to coincide with my birth record when I took the bar exams.

what paper works am i gonna be needing to file the discrepancy?

zbaby, you will need to first ask the schools and issuer of the docs what their process and requirements are.

i see... one last thing though, once i have my records switched to my real nme,.. do i need to do it on my primary school rec?

Hindi ko po alam kung ano ang dapat kong gawin, iba po kasi ang spelling ng given name ko sa birth certificate ko kesa sa ginagamit ko sa school hanggang sa nagpakasal at nagka-anak at nag trabaho ako yung nakasanayan ko na ang ginamit ko at hindi ko po sinunod yung nasa birth certificate ko... puede ko po ba maayos na sundin ko n lang ung spelling ng pangalan ko s birth certificate and pabago ko na lang ung sa mga school records, marriage contract, birth cert ng mga kids ko? patulong lang po ala po talaga ako idea kung ano dapat ko gawin.... maraming maraming salamat po.....

Yes po, rachel po ung nakalagay sa birth cert q ang ginagamit q po ay raquel....sana po mapayuhan nyo po ako kung ano ang dapat ko gawin...maraming salamat po....

you should go to the civil registrar where you birth certificate was filed and inquire regarding their process for correction of clerical error or change of first name. the law regarding this is ra 9048. good luck.

Ano po dapat kong gawin ngayon Sir? Wala siya trabaho ngayon, excuse po ba ung kawalan niya ng trabaho para ibasura ung isasampa kong kaso? Di po ba dapat gumawa siya ng paraan para maibigay ung suporta niya sa bata? Wala din po ako trabaho ngayon Sir, nagresign ako nung 3 months pa lang tiyan ko dahil nahirapan ako sa pagbubuntis. lyn, only you have parental authority because you are not married. if you have doubts about wanting him in your son's life, you can put blank on the father's name so the child will have your surname.

note though, the child will not have a middle name and will make it difficult to ask for support from the father.

what i recommend to you is to have the father execute an affidavit of acknowledgment now. that way you have written proof that he acknowledges he is the father and you still have the flexibility of what name you will put on the birth certificate. without acknowledgment in writing, it will be difficult for you to demand support.

it is useless to put his name on the birth certificate if he doesn't sign it.

if you use your surname, there should be no middle name. some people try and get away with it. the purpose against the prohibition is that you will appear to be siblings instead of mother-child.

no, for illegitimate children, only mother has right to parental authority.

for the child to use the father's last name, the father has to sign the birth certificate. it is allowed even if not married.

i am not knowledgeable in canadian immigration law. you can tell your family to refuse to give the child, but if he files an actual case then he might win over your parents. but not against you if you are here.

kelangan po ba sir na pagkapanganak ng bata, ireregister na po xa agad? What if po sir,nagkataon na wala ung ama ng bata,can i still put his name as the father of the baby and send him the birth certificate for him to sign it?

If the signature of the father can not be secured which is indespensable unless already dead the proper recourse is not to file it right away but rather to be belatedly file the birth certificate para di magkaproblema ang bata later in life

tip, you can even get a form for the birth certificate now and have it pre-signed, but he should be willing to do this.
