pwede bang magresign ang Probationary Employee?

two weeks ago ng mag sign ako ng contract as probationary employee, for web developer position.
based sa contract na pinirmahan ko bawal ako kumuha ng kahit anong projects even after working hours ko sa company.
pag napatunayan na tumatanggap ako ng project kakasuhan daw ako at mag ffine pa ako ng PHP300,000 sa company.

for probationary employee, meron kaming salary ng PHP350 per day.

then 1 week after signing the contract, meron binigay sa amin na rules and regulations.
ang pinaka ayaw ko lang naman dun si kapag wala kang output within the day you will be marked as absent, so affected ang sweldo ko.
minsan kasi dahil nga sa web programming ang ginagawa namin.. may times na hindi ako nakkatapos ng isang task sa buong maghapon.
which is common naman talaga pagdating sa programming lalo't malaki ang sakop ng ginagawa ko.

so upon calculation ko I will only receive less than PHP7000 a month!
which is bad kasi meron akong binubuhay na pamilya at parang hindi makatarungan yung ganung klase ng sweldo.
may 2 years experience naman ako kaya napag isip isip ko na mag resign na lang.. kahit dipa tapos yung probationary period ko.

ang question ko.. possible ba na makapag file ng case against me si company kung sakali magbigay ako ng immediate resignation?
natatakot kasi ako dun sa fine na PHP300k if ever mag file sila ng case against me.
sa twing magsasabi kasi ako na magreresign na lng ako lagi nilang pinananakot sakin yung contract na pinirmahan ko/

Pwede kang idemanda pag hindi tinupad ang tamang paraan sa pagresign.

paano po ba ang tamang paraan ng pag resign? yun po ba yung 1 month notice?
sa tuwing magpapaalam po kasi ako na magreresign na ako.. lagi nilang sinasabi na kakasuhan nila ako..

Im not a lawyer, but from what I know, a probationary employee can resign anytime -- there's no need to tender a 30 day notice. Unless of course, your contract stipulates that.

The Labor Code is clear.

The resignation "clause" (Art 285) does not distinguish between regular and probationary employment when it comes to proper notice. So it applies to all equally.

ART. 285. Termination by employee. - (a) An employee may terminate without just cause the employee-employer relationship by serving a written notice on the employer at least one (1) month in advance. The employer upon whom no such notice was served may hold the employee liable for damages.

(b) An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:

1. Serious insult by the employer or his representative on the honor and person of the employee;
2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;

3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and

4. Other causes analogous to any of the foregoing.

so ganito po.. sinearch ko sa website ng SEC at DTI yung company name namin kaso wala akong nakita. possible kaya na hindi registered yung company na kung saan ako pumirma ng contract?
