Pano po ang proseso ng Family cases like custody. Kailangan pa ba dumaan muna sa barangay? Or pwedeng direct filing na sa korte? Dadaan pa ba sa piskal muna kung direct filing? Saka may prescription ba to nullify marriage kung void ab initio ang kasal?

I think children born out of wedlock or outside marriages are considered illegitimate.

Kung dumaan sa court ang nullity of marriage, nagkaroon ito ng decision at finality na void ang marriage, ang mga batang na ipinangananak sa ganitong case tulad ng nasabi mong void ab initio ay nagiging illegitimate.

Once marriage is declared void by court, children would be illegitimate. They would be under full parental and custody of the mother unless court finds compelling reasons not to have the children under mother's care. Welfare of the kids would be considered in regards to this.

May kasalan bang nangyari? Ikaw ba ang tatay o nanay?

Kung ikaw ang tatay at hindi kasal, visitational rights ang hihilingin mo sa court dahil sa mother ang full custody at parental authority ng illegitimate kids tulad ng nasabi sa una.

Kung ikaw ang nanay at hindi kayo ikinasal, kailangan mong ipaglaban na sa iyo ang custody ng bata sa court kasama na ang financial support.

Kung kasal kayo, magkasundo kayo sa paraang maayos. Kung hindi, idaan naman sa legalidad at court.

Oo mas maganda sa court para legal.

hindi ba madidismiss kapag direct filing sa court sue to tecnicalities na hindi dumaan sa mediation ng barangay? para san ba yung sa barangay ng hinihinging certificate to file action? saklaw ba nun ang family cases for custody?

and sorry wala naman kasalanan nangyari, marital arguments lang na humantong sa hiwalayan pero no physical abuse naman na nangyari.
