SSS Loan To Be Automatically Deducted on BackPay..Is it legal?

Hi,

I was about to resign to my current employer when i heard that my outstanding SSS loan that i filed while still connected with them will be automatically be deducted on my whole back pay, I was never informed it when we get hired, there no clear statement on my contract that i signed as well when i started with them about it, is it legal by any chance? is it possible to ask for a waiver not to deduct it on my back pay and ill just personally pay for it? Please help.

I dont see it to be proper. You are still the borrower, and the employer is only tasked to deduct monthly payments as they fall due but not to collect the entire amount of loan from you. It is your own liablity to the SSS which earns interest if you do not pay and would be deducted from your retirement benefits in the future in case you still fail to pay. Of you can always talk to your employer and point this out

Of course it is legal. Take note that you are paying SSS through deductions from your pay. You borrowed the amount through your company while still connected with the company. As far as SSS is concerned, it is still your company who will pay your loan. Do you think your company will pay your loan from its own pocket since you're no longer connected with them? Of course, the amount of the loan will be deducted from your last pay and will be paid to SSS.
