Hello sir/mam,

We have a small sari-sari store which we installed inside our garage area for us to have extra income. It's been running good for about a month but when our landowner visited our place she told us to remove the store because she said it's illegal due to the apartment's business operation is classified as residential. Our sari sari store occupies about 3/4 of our garage which is about 3 sqm and has a starting capital of 5 thousand pesos. It is only a small store like what you always see within the your Barangay area. She claims she know the law and has given us one week to remove the store otherwise we will have to look for a new apartment. My question is is it true that it's illegal to set up a sari sari store in our apartment? And is it legal to have us removed from our apartment if what she says is indeed true?

It's POSSIBLE it's true. There can be local differences.
/A landlord/complex can have special rules. (Check the lease contract, or if there are any written policy for the complex.)
/Or there can be local rules in the baranggay. (Check at the barangay/municipaly office.)

Thanks for the info sir. We didn't have any contract when we started renting out the apartment and the barangay told us there's no problem in putting up a sari sari store thereby granting us a barangay business permit.

It seems the landowner is only scaring us to close down the store because she is related to a competition in the same street.

We already closed the store to avoid any future confrontation and also plan to move out.. but before we do, we plan to talk to the BIR for they have not given us proper business receipts in 5 years of staying with them. Is there any advice you can give in doing this?

Yes not worth to have fight about such, better move.

Do you have a BMBE (=Baranggay Micro Business Enterprice) registration type?
Such are much better, because they are INCOME tax free for the OWNER Smile (Other taxes are the same.) Such have some more benifits and are much easier to register.
