Arresto Menor

Hope all is well Atty. I few questions in mind, but before wr proceed let me give u an overview first.

My dad works in Academe. He has different Academic Affiliations and at the moment is holding a Board of Director post. Meanwhile, the mistress is a College instructor. They are both working on the same field.
My sister and I have known their relationship a few yrs back but we chose to keep it to ourselves. Not until my Mom freaked out. It brought mental illness and depression to her. The illicit affair has been running for 7yrs now. My mom was able to collect all evidences from anniversary cards, SMS, pictures. Our family has always been tight on our budget only to find out that the mistress has been travelling outside the country every now and then. She has been spending my Dad's money to her heart's content. My mom tried to talk to my dad but he did not give a single word. Instead, he hit Mom with his belt and blamed her for his misfortunes. By the way, my father is suffering from End Stage Renal and now a dialysis patient. (God's karma to his doings)
My question are the ff:
1. As a daughter, can I file a concubinage case against them or does it have to be my mom? (I dont think my mom wants to, but as the eldest, i believed they deserved that)
2. I made a fake FB account named after the mistress. I added her students and posted her wrong doings to us. Can she use it against me? Is it a libelious act?
3. I send a message to the school where the mistress is working and informed them about the illicit affair. Is it subject for her termination?
4. Since my parents have conjugal properties, can we demand for all the properties to be awarded to my mom? Like what Ive said earlier, the mistress is splurging on my Dad's money and we dont want her to benefit on that.

I really want to put an end on my mom's ailing. I dont care about my Dad and her mistress anymore. They can be together as they wished. But I just want to get even with them. Thanks for hearing me out. Hope to hear from you soon.

Hi,

I'm sorry to learn about your mom's sufferings. I am quoting your questions below in order to properly address them:

1. As a daughter, can I file a concubinage case against them or does it have to be my mom? (I dont think my mom wants to, but as the eldest, i believed they deserved that)

Only your mom can file a case of concubinage against your dad and his mistress. In concubinage, however, there has to be sufficient proof that your dad and his mistress are living togetger as a couple. If not, what I will suggest is for your mom to file a criminal complaint against your dad for violation of RA 9262 (Anti-Violence Against Women and Their Children) for psychological and physical violence/abuse.

2. I made a fake FB account named after the mistress. I added her students and posted her wrong doings to us. Can she use it against me? Is it a libelious act?

It can be a violation of Cyber Crime Law.

3. I send a message to the school where the mistress is working and informed them about the illicit affair. Is it subject for her termination?

It depends on the management of the university.

4. Since my parents have conjugal properties, can we demand for all the properties to be awarded to my mom? Like what Ive said earlier, the mistress is splurging on my Dad's money and we dont want her to benefit on that.

If you mom doesn't have plans of legally having their marriage declared null and void (should there be grounds for that), your mom can ask for legal separation from your dad because of marital infidelity and since your dad is at fault, he can forfeit his share in the conjugal properties in favor of you and your sibling.

Should you need legal assistance, you may directly email me on km@kgmlegal.ph

Regards,
Atty. Katrina
