Fake birth certificate to get married

Good pm. Yung kuya ko po kinasal when he is 21 and 17 palang yung girl. Ikinasal sila kasi po tinakot sya nung tatay nung babae na kakasuhan sya ng rape kasi buntis na po yung babae. Walang ceremony na nanyare. Nagpirmahan lang. Before that, yung birth certificate nung babae is pineke. Nagpagawa daw po sa recto para ma fake yung age. Because of early marriage na din, they decided to end things up. Hiwalay na sila. And now, 31 na po sya and may gf na sya bago. Mag one year na sila. Pwede po ba maging isa sa dahilan yung pag fake ng birth certificate para ma annull siya? He was planning to file an annullment case po.

Yes, if your brother can prove that his wife was in fact only 17 years old at the time they got married, their marriage is void from the beginning and he will need to have a court declaration for that.

May follow up question po kami kung pwede po, naganap po yung marriage nila is sept 2001 while sa marriage cert po nakalagay is july2002 including the marriage license. Sinakto po nung judge na 18 yrs old yung babae sa document. But on the other hand, sa birth certificate po nung anak nila feb 2002, married and 17 yrs old ang nakalagay sa info ng babae. Another thing is yung address na nakalagay sa kuya ko po eh hndi namin alam kung saan. Sa ibang lugar po kasi daw nag file kung san may kakilala ang judge. Is it enough para mapatunayan na 17 yrs old yung babae? Salamat po atty.
