I registered a business name which has been inspired by a term in one of my favourite novels. That term doesn't exist anywhere and isn't really a language. Maybe the author just made it up. And since my business is a travel and tours and that term in the novel also means 'travel,' I used it. I searched for the term if it has a copyright and trademark but there's none. Well, of course, the author's novel has(copyright) but for the term alone, I didn't find any. I am just worried that she might sue me one day? The author is an American, btw.

I already asked a my friend, who is a lawyer, before I registered it to DTI and he told me that there's nothing wrong since the term wasn't trademarked. But still... I'm just trying to be circumspect, so as to avoid conflicts once the business has been established.

I BELIEVE - if your business avoid geting bad reputation Smile - if the author ever notice, he will be flattered Smile

So does that mean that it's okay?

Yes. No problem when it isn't trademarked WORLDwide.

But before you decide, check if the wanted DOMAIN adress is not occupied. Preferingly the .com

If I trademark it here in the Philippines, is it only trademarked worldwide or only within the country?

Copyrights of texts, music and movies are protected worldwide automatic for free
while other protections as trademarks and patents can be for different big parts of the world. These later protections cost money, so you don't need to worry about the author.

You can protect your business name for different high fee depending of just local or for whole Philippines. Just rough from my memory I believe protecting whole Phils cost around 2500pesos.
