Arresto Menor

Dear Attorney,

I am a landlord residing in Sampaloc, Manila while my tenant and the subject matter property is situated at Tondo, Manila. Evidently, both of us belong to the same city but we do not belong to the same barangay...

Question:

Whether or not direct filing of judicial complaint for ejectment before the Metropolitan Trial Court of Manila is tenable in the absence of baranggay conciliation, considering that we do not belong to the same barangay.

the rule is that if you both live in the same city, you have to file a complaint first at the bgy of where the respondent resides.
