Good day po. Itatanung ko lang po. May bahay at lupa po parent ko tapos nagkautang po sila sa bangko. Yong father ko po matagal ng patay at may 7 po akong kapatid. Ang issue po ngayon gusto ko sana itanung kung paano maililipat sa pangalan ko ang titulo. Kasi usapan po namin ng nanay ko na ako na lang tumubos ng bahay sa bangko at akin na lupa which is pumayag naman kapatid ko. Ngayon po natapos ko ng bayaran yong utang at gusto po sana na maayos yong titulo. Ano po ba dapat kung gawin? Anong mga hakbang at kailangan para mailipat sa pangalan ko ang titulo. Deed of donation po ba ito or deed of sale? If deed of sale po ba need pa din yong signature ng mga kapatid ko or nanay ko na lang? Sana po matulungan nyo ako kung anong dapat kung gawin. OFW po ako sa abu dhabi kaya gusto ko po malaman mga kailangan kung gawin bago ako umuwi para ayusin ito. Salamat po

I presume that the property belongs to both of your parents. At the moment of death of your father, his share in the property was automatically transmittes to his legal heir (may last will and testament man o wala). His legal heirs are you, your mother and your siblings. Thus, your mother cannot sell or donate the whole property without the other heirs' consent. Best to do is to have an extrajudicial settlement with absolute deed of sale or waiver of rights. You consult a lawyer kung san ka makakatipid kasi magbabayad kayo ng estate tax plus capital gain's tax or donor's tax. The fact that you reďeem the property does NOT make you automatically entitled to the property as owner. Your rights include only the right to be reimbursed by the other heirs dun sa binayad.
