I was facing right now a case of reckless imprudence resulting to serious physical injuries and damage to property. Status of the case was filed already at MCTC.
The collision happened last March 2015 when am driving my motorcycle along the four way lanes of Maharlika Highway from north to south. Ahead of me is a tricycle. Both vehicle was on the fast lane. Then I noticed the tricycle slowed down and doesn't move to the outermost lane for slow moving vehicle, but then stopped on the fast lane of the said highway; a more or less 400 meters going to TPLEX right. So I overtaked on the drivers side. When my motorcycle was almost parallel to the tricycle, the tricycles driver made a sudden left turn that caused the collision of our vehicles.
As monetary assistance I gave him 10K for his broken leg. But after he was out of the hospital they filed a case against me.
Both of us driver is holder of student permit. My motorcycle is REGISTERED. The Tricycle is UNREGISTERED.
Under the JOINT ADMINISTRATIVE ORDER NO. 2014-01 of DOTC Section I. e. Reckless Driving. last sentence qouted "This includes driving an unregistered vehicle under Section II.a hereof".
From the above cited information, need for advise, opinion, additional info to support or case related, inputs, comments, endorsement, etc. to all of the guys out there. A million thanks in advance.
