Slight Physical Injury

Hi Attorney,

I have a question regarding my case for slight physical injury. Nagfile ako ng complaint regarding this girl na nakasabay ko sa jeep, na nang-apak sa paa ko without saying sorry and sya pa ang galit sa akin, and nung bumaba ako, sinabi ko sa kanya na ayusin nya ugali nya kasi sya na nakasakit, sya pa ang galit.

Unexpectedly, habang bumababa ako, hinila nya ang buhok ko, then pinagsusuntok nya ako sa braso. I dont have plans of fighting her back kasi nakauniform ako (btw I'm working on a radio station) and ayoko madrag yung pangalan ng station kaya hindi ko na din sya pinatulan.

Naidentify ko yung name ng babae with her ID lace and thru facebook. May mga common friends pala kami pero totally, hindi ko sya kilala. The next day, nagpacheck up ako and nagpa blotter. And nagfile ako ng complaint sa pulis. Right now, nasa mediation kami and sinabi ko na wala ako balak makipag-areglo.

My question is, what will be the next procedures after mediation? Alam ko ako ang agrabyado, but people are trying to discourage me na makipagareglo na daw ako kasi slight physical injury lang naman yung kaso. Even the mediator is trying to please me na wag na ituloy kasi masyado daw mahaba yung proseso, and at the end pipilitin din naman daw kami pag-ayusin.

But it's not the case e. Gusto ko turuan ng leksyon yung babaeng nanakit sakin. And I'm trying to make things legal.

What are the possible counter actions na pwede gawin nung accused?

pwede mag file ng counter charge ang other party,
it will be battle of who gets the upper hand,,, witness,,, and proofs..
none is sure....

Is their a period of time for doing the counter charge?

anytime,
during the original case.
after the case was dismissed.
or after the case is already in court..
iba yong counter-affidavit,, na needed 10 days to submit fter the sub-poena.

And what can be the possible counter charge?Im sorry a. Wala kasi ako alam. Thank you for responding.

article 26 of NCC, public scandal,,, etc...

Kahit na hindi ko sya sinaktan? It's impossible na makapagproduce pa sya ng medico legal.

its a battle between ur evid vs her, ur proof vs her,,,

parang ganito lang yan..

sabi ng girl, rape daw,,
sabi ni boy, BF/GF daw cla,,, at walang nangyayari,,

so cno papanigan ng court???

so kung merong video, or pictures of romance, sino ang meron case?
then pwede naman icontest ng isa ang authenticity ng each evidence,,

nasa kanilang dalawa yan.. so same case sa inyo,,
kaya nga ang payo sa inyo eh, mag settle na lang,, out of court,,,

kung hndi naman abala sau ang mediation? then go even long proses pa yan. see to it lng na hndi maapektuhan ang work mo and iba mo sched. may point ka na hndi na makaka pag provide ng med cert ang kabila.

in other way sa ganyan mo sya turuan lesson. see to it lng na kaya mo ihandle ang sched at abala at gastos.

i mean.. bigyan mo sya lesson sa ganyang paraan.. pero kung ikaw na ang maapektuhan sa sched at sa gastos at keri naman pla nya ang lahat ng abala?

then mag pa areglo kna.

but if i wer you kung di naman ako maaabala at makikita q na sya ang na-aabala at na peperwisyo sa case na yan?

then let her be!!

tru her fb gather some info sa mga capabilities nya.. if sa palagay mong unfit sya sa time para sa mediation and some hearings na dpt na ma attendadn nya? then hayaan mo ma perwisyo. but if ikaw na ang apketado at naabala?
