Hi,

Magtatanong lang po ako tungkol sa lupang inoofer sa akin. May roon po kasing lupang pinagbebenta sa akin na Rights lang daw po ang ibibigay. Ano pong ibig sabihin noon? Ang lupa ay agriculture land. Sa ngayon yan lang muna ang information na nakuha ko. Salamat.

i think we had a fresh thread related to lands without Title or
Rights lang..
eto kasi yong mga Government donations or NGO's.
usually 1 big land will be given to specified number of beneficiaries, say 20 households or one association,
then the families can live there, thus like owning the property, but they can not sell since they have no Title for thier own.
there are also NHA programs, that lots/houses are offered with lower costs,, after say 25 years, and already fully paid, they have grace period of say 5 years. that the property can not be sold... during that time, commonly the owner says, rights lang meron ako, kasi wala syang title to show, or meron na, pero merong restrict to sell provision.
after the grace period, then the NHA, will finally gave them the Title, kasi binayaran naman nila yon, so that time, legal sale is ok.

What about taxes po? Or any obligation ko after acquiring the land. Is the payment also different from a land with a title? Can this also be transferrable (eg. Donation) thanks a lot

yong sa mga associations,
usually meron yan elected officials, then cla yong nag-aayos nyan,
yong mga bayaran, contribution yan ng lahat ng members.
actually, sa ganyan me lumaki, tatay ko president assoc nila, but 39 na me, rights pa lang din meron tatay ko.

You mentioned po na government donations ang mga ganito. I have several inquiries lang po:

1. Kung association ito, ibig sabihin ba nun ay puwedeng gamitin ng iba ang lupa mo provided na kasama ka sa association?

2. Kung pumanaw ang may naghahawak ng rights puwede ba ito maipamana sa anak?

1. ang rights eh para sa mga members lang, di pwede kung di member.
2. inherit ng heirs.

I didn't understand which it is:
1, A NEW GROUP offer? (Then see above.)

2. Or an INDIVIDUAL (=ONE family) situation? Have you USED the land long time?
People who have used government owned rural land many years and payed tax for it can even get TITLE for it.
a) If same family have used it since soon after WWII, then they get the title in own name, if just apply and pay a rather small fee. (It hasn't been for "timber land" but I read somewhere it has been/will be changed to include such land too.)
b) If same family have used and payed tax for it at least 10 years, then it isn't sure but a good chance to be approved to get the land titled in own name.
