Kahit ang apelyido ng bata sa birth certificate ay sa ama, maaaring papalitan ng ina ang talang ito sa pamamagitan ng isang proseso sa hukuman. Kinakailangan niyang maghain ng petisyon sa Regional Trial Court sa lugar kung saan matatagpuan ang Local Civil Registrar kung saan siya rehistrado para sa pagpapalit ng pangalan (Petition for Correction of Entry in Civil Registry and for Change of Name).

Sa nasabing petisyon, kailangang ipawasto ang kanyang apelyido mula sa apelyido ng ama upang dalhin nito ang apelyido niya. Kailangang may kalakip ang petisyon na mga dokumentong nagpapatunay na hindi siya kasal sa iyo na ama ng iyong anak bilang patunay na ang apelyido na dapat na dinadala ng iyong anak ay ang kanyang apelyido.


Kapag naihain na ng ina ng bata ang Petition for Change of Name, maaari kang dumulog sa korte upang ipahayag mo ang iyong opposition.

Aww. Ganito na lng po. Pag nag annulment po at nagrant na. Ang gagawin is aalisin ung apelido ng ama at gagamitin ang apelido ng nanay. Pde po ba yun? thanks po. Kumbaga walang tatay na ilalagay sa birthcertificate

complete na nakalagay or surname lang ng father?
ilang taon bata,
nakaregister na or ireregister pa lang??/


wag muna magbilang ng itlog, habang di pa nangingitlog, baka mga sisiw pa lang yan, di mo pa sure kung lalaki or babae,,,

Hi! I have a query regarding the birth certificate of my daughter. 2009 when i gave birth to my daughter, the father of my daughter was the one who register my daughter. 2012 when we got married. until now my name appeared in my daughter's bc was still my maiden name. I was advice to file an affidavit of legitimation. unfortunately, the civil registrar where my daughter was registered, told me that to execute and affidavit of legitimation, me and my husband should appear in front of the issuing legal counsel. My problem now is that, I could no longer reach my husband because he left us which also the reason why i filed ra 9262. Can i possibly obtain an affidavit of legitimation by myself without the presence of my husband?

by the way, there are also errors in my husband's birth certificate which we only found out after we got married, when we got a new authenticated bc, there was an annotation on his bc abour corrections on his middle name and mother's name. I am confused already with the birth certificate issues of my husband especially now that he abandoned us already. If ever, can he change his name by using his corrected name in the BC? can he chose a single status since he has a different middle name already? will it affect our marriage contract and the entries in my daughter's bc? lastly, will this affect the case i filed against him? please enlighten me on this. I wanted to correct the bc entries of my daughter. Thanks

You listed several concerns.  Let me summarize my understanding for you to validate and rank their importance.
1. You want your daughter’s birth certificate corrected to show her father as her surname rather than your maiden name (without the father making a personal appearance at the office of civil registry with the mother).
2. You want your husband’s birth certificate corrected to show updated middle name and mother’s name.  You mentioned there is already an annotation on the NSO authenticated birth certificate.  (It appears this is already corrected.  Name will not change.  Annotation is sufficient to show the change).
3. With the corrected husband’s birth certificate, you want a certification of no marriage as you want to reflect his status as single.
4. You want your marriage certificate corrected to show your husband’s corrected middle name.
5. You want your daughter’s birth certificate corrected to show your husband’s corrected middle name.
6. You want to show your husband is married and yet single but you have a case filed against him.

Mas medaling makatulong kung maiclarify mo.  Isa isa lang muna.

my husband's BC is very complicated. okay going back to my email..i opted not to change anything on our marriage contract and our daughter's BC except that I wanted to change my maiden name in my daughter's BC provided that I have to file an affidavit of legitimation with my husband..Since I can no longer reach my husband now, I just wanted to know if i can still obtain an affidavit of legitimation without my husband?

birth before marriage, legitimation comes when you got married,
if pinanganak after marriage, automatic legitimate.
wala nang affidavit needed.

the mother's name appearing in my daughter's BC is my maiden name. I have inquired the civil registrar about it, and i was informed that i have to file an affidavit of legitimation so they can change the mother's maiden name as appeared in the BC. They told me that me and my husband must go together in obtaining the affidavit before a legal counsel. My husband abandoned us already, how can we possibly go together before a legal counsel for this affidavit? What should i do to obtain the affidavit of legitimation now? can i be given even without my husband?

i assume wala kayong pinakitang MC sa local registrar?
If meron, ang kailangan nila eh yong acknowledgement ng tatay, kasi
kung sakali mang nakasal kayo after ng birth ng bata, so walang linkage kung anak nya nga sya..
so acknowledgement ang kailangan,,,
at tama legal council in a sense na need eto notary, walang hearing na mangyayari..

regardless, ligitimation or acknowledgement, need nito ang presence ng tatay..

sorry po, batay eto sa pagkakaintindi ko...

the father acknowledge our daughter, kaya nga sa BC ng bata sila ang magka apelyido ng anak ko. So di rin pala pwde na di kaming dalawa ang haharap sa legal counsel para lang makuha ang affidavit of letigimation? If ever, kc nasa manila ang asawa ko ngayon, if ever na mkontak ko sya pwde bang dun na lang kami sa manila kukuha ng affidavit of legitimation or kailangan talaga dun sa birth place ng anak namin? thanks Smile

pero ang submission eh sa local registrar.
