Violation of Sec. 13, R.A. 9165

What's the best remedy for a woman, 76 years old and mistakenly identified by the police during the execution of a search warrant as the person named in the warrant, arrested and subsequently charged with Sec. 13, R.A. 9165 along with 2 other persons?

As stated in the complaint/information/record, she was in the house of her grandson and lying on bed when the police officers arrived consequently she was ordered to stand up and go to some police officer and made to sign a paper and so she did without reading, as she is illiterate or the least ask any question as she feared for her life

The names stated in the warrant was of her 1 son, 1 daughter and 1 grandson, during the execution of the warrant she was asked by the police officer if she was the one named and she answered "No" but they did not believe her.

She is already 76 years old, illiterate and a resident of a different city from where she was arrested. She has asthma and is currently in jail. Her arraignment is 4 months away and her family is very poor and cannot afford the services of a private lawyer.

Is there any way that she could be released or the case against her be dismissed?

Being senior citizen with prevailing illness, does not exempt anyone from the rule of law.
but her rights were violated, they did not give her any lawyer.
