I've gone awol in a company with a 2year contract. 8months pa lang ako regular na. May 60k bond ako. Anong case po ang pwede ifile saken? Nagawol po ako kasi ayaw ako payagan magresign ng hr hanggat di pa nababayran yung 60k ng cash. Nakiusap ko kung pwede installment kaso hind pumayag kasi ung mga gumawa daw dati nun. Hindi na nagbayad ng complete. Ngayon balak daw nila magfile ng case.

I have a reason for resigning. Hindi po ako masaya s work ko kahit ano gawin ko and toxic pa ung work. Ngkakasakit din po ako lagi.

If they file a case ano pong laban ko?

Assuming na valid ang bond, pwede silang maghabol sa iyo at baka wala kang laban.

Yung bond po training expenses daw. Pero ung naging training namen prang hindi nmn 60k tlga. Yung mga tinuro samen samthing na mtututunan sa school or self study. I think wala namang extra pay ung mga ngturo samen since employees din sila. (Yung naging training namin actually tulad lang din sa ojt and kami din pa nagtrain s ojt).

Sir Council's posts are also congruent to my take on your situation.

Kasama ba sa employment contract nyo yung pagpirma din sa pagtanggap ng bond for your training expenses? Ang general rule kasi sa mga contracts is once you sign, you are deemed to have consented to the terms and conditions written therein. Kaya yung last post ni Sir Council is valid, assuming that may employment contract na pinirmahan and part nga nung nakasaad dun is having a P60k bond...

One of the ways na pwedeng mapawalang-bisa yung employment contract (assuming there is) is yung sa pagkuha ng consent mo. Pwedeng napwersahan ka lang na pumirma, or di naexplain ng maayos yung terms and conditions sa iyo and pinapirma ka na lang ng basta-basta. However, nasa iyo yung burden of proving such kasi ang presumption sa batas is valid yung contract na complete yung requisites under the law (consent, cause, and object).

Di lang ako sure dito, pero pwede rin gamitin yung other angle na Contract of Adhesion yung pinirmahan mo. Basically, yung isang contract of adhesion pertains na yung employer mo has a stronger influence/power over the contract and you, as an employee, is the weaker party na walang power to negotiate the terms and conditions ng contract kaya constrained ka lang na pumirma and tanggapin yung nakasulat dun. Again, nasa iyo ang burden of proving na ganun nga yung contract mo, kaya please keep all the necessary documents sa employment mo para maging further documentary evidence.

Try mo rin magseek ng advice sa nearest DOLE sa inyo. Meron naman silang mga help desks na pwedeng mapagtanungan regarding such matters. Alternatively, try to look for the office of the nearest Public Attorney's Office sa area nyo, baka sakaling makapagbigay din sila ng free legal advice.
