NO CLEARANCE FROM PAST EMPLOYER

May I ask po if meron po bang pwedeng ikaso previous employer ko kasi hindi po ako nakapagclearance bago umalis sa work? Natapos na po 6 months probationary contract ko at ayaw ko na pong bumalik. I already made my resignation and signed by my immediate superior. I tried to process my clearance kaya lang palagi pong wala akong inaabutang signatories sa office. Kaya hindi ko na po tinapos. Thank you po. Sana matulungan ninyo ako.

Humingi ka ng tulong sa kaibigan mo para magpapirma ng clearance. Or tumawag ka sa kanila para malaman kung kailan andun ang mga signatories.

I am still a law student, so take everything I say with a grain of salt...

As far as I know, yung pag-alis mo sa company was voluntary since end of the 6-month probationary period na. Clearance procedures then come into play, and regulated yun ng mga rules sa company handbook nyo. There are no specific regulations in the Labor Code that deal with clearance issues, kasi company procedure yun and iba't-iba yung patakaran ng mga companies in regard with that.

What you could do is still try to finish the clearance process. Makiusap ka ng maayos sa HR nyo para mapapirma mo na yung clearance form mo since may usual na separation pay pa nyan na kasunod yan... Baka kasi may provision sa handbook nyo na after a certain period of time, an employee is considered to have waived his clearance benefits... Habulin mo pa yun, sayang naman...

Don't forget to ask for a certificate of employment para maidagdag mo din sa resume mo as experience...
