Dinemanda po ako ng employer ko ng qualified theft dahil ako ang nagbigay ng mga ebidensya (i.e. timecard, payroll) sa isang dating katrabaho ko na nagsampa ng reklamo sa NLRC laban sa employer ko. Ano po ang dapat kong gawin? Hindi pa ako nakipag-usap sa employer para makipag-settle. Aaminin ko po ba sa kanila na sa akin galing yung mga ebidensya ng dati kong katrabaho? Makukulong po ba ako dahil dito? Please po, need advise bago ako makipag-usap sa employer ko. Maraming salamat.

If ikaw yung company custodian ng timecard, payroll, then, baseless po yung qualified theft na sinampa sa inyo. It is your duty to give those things to your co-worker as an evidence in a labor case, kahit hinde mo ibigay yun, the labor arbiter can still requires you or employer to furnish that.

Hinde ka makukulong because that is a lawful duty, likewise, matanggal sa trabaho, because that is not even a ground for dismissal.

salamat po sa reply. Pero hindi po ako ang custodian. Yung payroll po ay humingi ako ng xerox copy dun sa custodian ng records without telling na ibibigay ko yun sa katrabaho namin na nagreklamo sa NLRC.
