Need your legal advice

my friend was employed without a contract in a pantry located in a building in eastwood. he stayed there for 8 months and was only paid 400 pesos for 12 hours of work. As per my friend he was abised emotionally and physically by his employer. Many times he was pat on the neck or pinch on his belly. Was also shouted and humilated in front of customers. When on duty during holidays or weekends they are only paid half (200 pesos) but still on duty for 12 hours without OT pay because her emplyer said that there's not much to do during weekends less number of customers so less amoung of work loads thats why they will be paid less. some of his co employees were terminated because of not going to work last dec 31. Need you legal advise if he can file a case against his employer. Thank you

Any lawyer or student want to help Me I filled adultery charges against My wife Im an ordinary ofw while working my wife is having an affair w/another married man now 5he mans family and my family is ruined...The prosecutor public really gas no real interest about my case areglo system even my 2 daugther who have knowledge of their affair but yes they havnt seen their sexual act.but they know because my wife use to sleep w/him in our edroom and dometimes in our small store she disappear during unholy our...I cannot apply in PAO lawyers because My income as ofw is higher than the indigent but also not high enough to hire a good lawyer..so if somebody who would like to give me true justice or if there is justice I ask your help..at the moment my wife is getting advices shes now creating problems because she is demanding ger conjugal rights in My small not tittled rights in pasig all my hard years of work yes in all honesty she commited crime that she admit to me and my 2 daugthers and she said she is sorry but now she renue her statement tbat she never admited it from her lawyer..hoping for your kind help assistance God bless Philippines and behalf of My fellow ofw having same problems and it could be millions hopi g that this to may become an eye opener and M willing that this ase could be published so that woman of this kind may know that crime does not pay..

You have to file at least a legal separation on the ground of infidelity. Your marriage would still be valid but if found that she is the guilty party, her share on the net income of your conjugal property will be forfeited in favor of your children. The difficulty of filing a case for adultery is that you have to prove beyond reasonable doubt that your wife has sexual relations with another man which if you have not seen will be difficult to prove.

Much better if you go to labor office nearest you bring all the documents e.g payslip etc. and make an affidavit with content of all the complain and story happened. If in case theres another complainant it is better to consolidate the complain in one

voluntary sexual activity (as sexual intercourse) between a married man and someone other than his wife or between a married woman and someone other than her husband; also : the crime of adultery .You should have a credible evidence like picture, video or certificate of birth of their romance (anak) perhaps marriage contract in order the case will prosper. A mere hearsay or what you said admittance by her will not bring good result to the case. I suggest that you formalize you separation to her that you will allow to separate the property divide by 4 including your children and the custody of you children will go to you. After that file annulment case base on her action getting the share for her benefit ,having affair with others , and for not fulfilling her duty as mom to your children. Psychological incapacitated will be the ground to annul you marriage.

first question: is there an employee-employer relationship? with that in mind, did your friend sign a contract regarding employee-employer relationship hence we can file a case against the labor arbiter if there is.
