Good day po. May iinquire po sana ako.  

Ang lolo ko po ang beneficiary ng CARP at pumanaw na po sya nung 1999. Ang mama ko po ay isa sa mga anak nya. Last 2012 po  ay nag meeting ang lahat ng mga anak ng lolo ko (except for 1 kasi nasa China) at ang lola ko na legal wife ni lolo. Lahat po sila ay pumirma  na ng waiver  saying na nag waive na sila ng rights nila ng lupa to my mother. Pina notarized na po namin ito. Now after all the process para ma kuha ang title from Landbank, we already have the title na under pa sa name ng lolo ko at two titles po ang binigay ng landbank kasi may national road na naka pagitan (1889 sqm at 3361sqm) . Ngayon po ang isang kapatid ni mama na nasa china ay may right pa rin po kasi di pa sya ng waive kaya plano lang po muna ng mama ko na itransfer yung 3361sqm sa name nya at yung remaining area ay iproprocess pagdating nung kapatid nyang nasa china.  Ang tanong ko po, pwd na ba yung notarized waiver ang gagamitin ni mama to transfer that certain area to her name kasi di naman po deeds of sale ang pinirmahan ng mga kapatid at mama nya? What are the other requirments po for the transfer? Thank you po and your reply is much appreciated.

Magtatanong lang on some steps to effect transfer officially.  Naikonsulta niya ba sa Department of Agrarian Reform kung maaari ito ?  Ang papel sa lupa ba ang Transfer Certificate of Title (TCT kung bayad na sa LBP ang lupa) o Certificate of Land Ownership Award (CLOA kung binabayaran pa)? Anong legal document ang ginamit niyo?  Extra Judicial Settlement ba with waiver?  Nasettle ba ang estate tax sa BIR?  Nakakuha ba ng BIR Certificate Acknowledging Recognition?

Hi thank you very much sa reply po. Lumapit na po kami sa DAR Atty to help us with the process and I think po lahat ng namention nyu sa reply ay naprovide na ng mother ko ( super hassle and traveling a lot just to get them and pabalik balik pa kasi super inefficient ng ibang staff but we got there so smile na lang- Smile ) . Btw,we've been told it might take at most 12months to get the transferred title.. thanks po ulit sa reply nyu

good day po. mag inquire lang sana po ako.. pwedi po bang ma aplayan nag title ang forestral land ng lolo ng mother ko.. kasi tax declaration lang po ito. tsaka matagal ng patay ang lolo ng mother ko. pero lahat ng mga maps sa geodetic surveyor at pero siya po ang binigyan ng power of attorney ng lola niya bago namatay . maraming salamat po.

Di sinakop ng DAR CARP ang forest land. Forest land ay nasa ilalim ng pangangasiwa ng Department of Environment and Natural Resources. Maaari silang makatulong through the Land Management Bureau. Sa proceso ng titulo, matatanong ito sa Register of Deeds.

Suggest ko, kumuha ka ng reference ng area at ng Special Power of Attorney.

Ayon sa DENR, "The survey, management, and disposition of Alienable & Disposable lands, including government lands not placed under the jurisdiction of any specific government agency, is a mandate of the Land Management Bureau, one of six bureaus of the Department of Environment and Natural Resources.

Among the major activities of the LMB include the conduct of cadastral survey of all municipalities and cities in the country, management of foreshore areas, and processing and issuance of land titles, as well as investigation and resolution of land cases involving rights conflicts of public land applicants."
