Good day atty. gusto ko pong padalhan ng demand letter yong mistress ng hudband ko. I was initially thinking to file Alienation of Affection to her but as I read thru most of your advises on this issue you prefer Demand letter muna.

If i would ask your service on this how much po ung fee? Currently nasa HONG KONG po ung mistress at yong husband ko so yong problem ko is I don't know her Philippines' and HK adresses. But i tried to check with POEA that if my request from atty. with consent of complainant pwede namn daw sila mg assist.

I am currently living in Visayas region.
Can you help me please. Thank you po

Hi,

May I know how you understand "demand letter"? Or do you mean you want to sue the mistress of your husband? If this is the case, then you can sue your husband and his mistress for:

1. Bigamy - a criminal case if your husband married his mistress while he is still married to you
2. Concubinage - if your husband is living with his mistress in the same home. However, if this is committed abroad, you cannot sue them for Concubinage here in the Philippines.

Hi Atty. thank you for your response. I have filed RA 9262 against my husband. Gusto ko rin sana kasohan yong mistress pero masyado ho silang alert magtago at umiwas. They make it appear na wla na silang relasyun when in fact just last Sunday my nakapag send sa akin ng pictures na magkasama silang dalawa sa isang event dun sa HK. Gusto kong takutin din ang mistress pra kahit papano makaramdam din ng takot sa immoral nyang gawain. Nawasak ho ang pamilya namin dahil sa kagagawan nilang dalawa. My apat ho kming anak ng asawa ko.

Kaya ho kahit yong demand letter nalang ho muna. Eventually i am contemplating to file a case of Alienation of Affection later.

Hi,

You're welcome. We don't have a law on Alienation of Affection here in the Phiippines. But, you can sue the mistress under Article 26 of the Civil Code for interfering with the affairs of your family and ask for damages (monetary award) for what she did. Just gather enough evidence regarding their affair in preparation for filing this case in the future, should you decide to do so. Hindi po kailangan ng demand letter sa ganitong action.

Thank you again attry. What if po I'll opt to just send the mistress a Demand letter para makaramdam din ng takot. Gusto ko kasi munang mag focus sa case ko laban sa mister ko. Magkano po ba yong service nyo on this?

You're welcome. The remedy po is not to send a demand letter. If you wish to sue the mistress, diretso na po yun sa court, no need for a letter. Usually, a demand letter is sent to a person in connection with a monetary obligation based on law, contract, etc. In your case po, sending a demand letter is not the remedy.

Para saan ang letter? para takutin? Since nasa HK siya, i don't letter will deter her. File a case, that is your best move.
