Arresto Menor

Hi, i need you help for our debate about the fortuitous event. The question is "is the debtor who are incapable of performing the obligation due to the said typhoon will extinguish the obligation" and we are in the affirmative side...
As a general rule, it will extinguish, but there are also exemption in art.11744, can you help me to fight for our side that there are no liabilities and some legal basis..
