Arresto Menor

Dear Atty's
Dear Atty's,

Relate po ako sa story ng 2 MRS REAL. I am the 2nd wife, married in civil rites. Honestly, prior to our marriage hindi ko alam na married na pala siya, kasi siya lahat nag ayos ng requirements namin sa city hall. It was a beautiful relation pero syempre lahat mabibisto pa din. So ito, nung kumuha ako ng CENOMAR, it appears na parehong NSO registered yung kasal. Yung first was in 1999 in Rome then in 2010, yun sa amin in Manila.

Wala na silang communication ng first wife, from 2007 until now.

Question, can we get married in church here in Manila even without the annulment (since wala pa naman napa file kasi wala ngang communication sila; hindi alam kung pano sisimulan at sino una mag pafile).

How much na kaya ngayon yung annulment, para sa aming mga middle class earners lang?. How long will be the processing if example yung asawa ko na mag file nito dito sa Manila. Can he do it po or need pa niya hanapin yung first wife?. May mga nag a-accommodate po ba dito tulad ng PAO or private/practicing lawyer na service is waived, then yung annulment fee lang po ang babayaran?

Sana po may makapansin ng tanung ko po. We want to avail po sana a free wedding/ kasalang bayan this coming November kaso worried ako since Im sure void naman yung kasal ko kasi married sa first yung asawa ko. Baka mas lalong gumulo ang records if ever.

Thanks,
Ayrin

Reclusion Perpetua

His first marriage remains valid until death or declaration from court. it is wrong presume that a marriage can be nullify due to lack of communication for so many years. Your best remedy is to have your marriage declared as void due to bigamous reason, then file an annulment for his first marriage. After the petition was granted and all finalization is done, you can get married. remarry. Cost??? Depende sa lawyer, but to be on safe side ready your 100K to 150k max.

Good luck!
