(Pasensya napo at mahaba)

I am a culinary student. Ang program is consist of 2 courses, part 1 baking and part 2 culinary.

Now after baking, next na culinary ko.

Eto po yung section ng handbook for the refund policy:

Withdrawal for Cause. The student shall be entitled to immediately withdraw from the Course by giving written notice to (Name of School) of his intention to do so under the following circumstances:
• The School fails, for any reason, to commence the course on the commencement date;
• The School terminates the course for any reason prior to the commencement of the course;
• The School is in material breach of its obligations under this Agreement.

Refunds for withdrawal for Cause. The School shall, as soon as practicable after receiving the Student’s notice of withdrawal under clause II.a (and in any event no more than thirty days after receiving such notice) refund to the student:
• The entire amount of the tuition and miscellaneous fees.

Withdrawal without cause and refunds. Where the student withdraws from the course from any reason other than those stated in II.a, the School shall, as soon as practicable after receiving the Student’s notice of withdrawal (and in any event not more than 30 days after receiving such notice) refund to the student the following sums (less any applicable bank administrative charges):

Refund Policy Table

% of (the aggregate of the course fees and additional fees paid)

90%
If student’s written notice of withdrawal is received
More than 30 days before commencement date

50%
Before, but not more than 30 days before the commencement date

0%
On or after the date of commencement

0% refund for Miscellaneous Fees
Non-refundable

Question 1. What does commencement means? Dalawa po kasi ibig sabihin, 1) graduation; 2) beginning; contradicting po.

Question 2. Allowed po ba sa batas ang 0% refund policy? Talaga po ba wala na ko marerefund?

Thanks in advance Atty.

late grades are also a problem in law schools. midway through the sem, you find out kicked out ka na pala because of grades from last sem which just came out.

i believe commencement means beginning of classes. have your culinary classes started?

how much is the tuition involved? i believe much of your tuition goes to materials, and if they didn't have to spend because you withdrew, then there should be at least a partial refund.

i have not come across a case decided by the Supreme Court regarding this matter. if you wish to pursue a refund instead of continuing, you should first file a demand letter for a refund then file a small claims case against the school. rules on sc.judiciary.gov.ph.

Thank you for the response atty.

the tuition for the Grand diploma is P195,000 that includes baking and culinary, in other words parang "package". This school also offers Certificate in Baking and Pastry Arts which is around P88,000 and Diploma in Culinary Arts at around P115,000.

The baking class started last july and ended 1st week of this month. right now it is semestral break, and the culinary class hasn't started yet.

I havent started the culinary class yet, so may chance pa kaya ako makapag refund against sa zero refund as stated by the school?

Thanks and more power!

you will have to convince the school to pay you. it states that you can refund if it's 30 days before school starts.
