Hi to all. I am working for a multinational company who setup an operational center here in the philippines. I've been working for this company for 4 years unfortunately they decided to outsource our business unit before the year ends. This is just part of their efficiency drive so the company will remain existent. The plan is for the 3rd party vendor to absorb as much as they can from the current workforce of our bu.

I have a few questions surrounding this matter?

1. Can i refuse to sign the contract from the 3rd party vendor?
2. If I choose not to sign, can i expect a severance pay?
3. Can they force me to resign if i chose not to sign the contract from the 3rd party vendor?

I would like to seek your legal advice on this matter. Your responses will be very much appreciated. Thank you.

1. Yes. It's your prerogative.
2. No.
3. They cannot "force" you to resign, but in effect resignation will be the result once the BU is sold and you are not joining the new company.

Hi Council. Thanks for the response. I have a follow up question.
The business wasn't sold but the work was outsourced. That's different right? Technically they will pay a third party service provider to do my job but the rest is BAU. Does it mean I have no choice but to move to the 3rd party vendor? I'm actually expecting that they will redundiate me. TIA.
