Magandang araw po attorney, Sana mapaliwanagan nyo po ako, litong lito na ako eh. Kasi yung kaibigan ko may ka live in partner na foreigner, yung foreigner separated. Pwede po ba silang magpakasal dito? Yung foreigner kasal dun sa italy. Maraming slamat po... Embarassed Embarassed

kung may divorse sa bansa ng foreigner at divorse na puwede pero kung subsisting at valid pa rin yung marriage HINDI kasi po and maggogovern na law po dyan ay yung NATIONALITY LAW ng foreigner. Surprised

Thanks for the reply busty.... I appreciate it... For now im happy for my friend kasi, yung foreigner is now processing for the divorce...and my friend told me by the end of this year, mtapos na yung divorce...:-)

Isa sa mga requirement kung magpapakasal ang isang foreigner sa isang Filipina ay kailangan may "legal capacity" ang dayuhan para makapag-pakasal. Since valid pa ang kasal nung Italian, hindi sila maaring magpakasal.
