Good morning!
Hihingi po ng advice. Nagsix months na po ako sa work ko nung aug17. Nagfile po ako ng resignation sept1. Di ba po dapat may 13th month pay na ako? Ano po ang dapat kong gawin kung hindi po babayaran ang 13th month ko?

Hindi pa po. Yung mga service crew po namin hindi sya nagbibigay kahit pinapaliwanag ko na nasa labor code yun. Ang sagot nya sa kin sa staff lang sya magbibigay at ako yun. Kaya lang po ayaw nya tanggapin ang resignation ko. Kaya iniisip ko na baka maupset sya pag pinagpatuloy ko resignation ko and hindi sya magbayad ng 13th month ko. Kasi may history sya na hanggang salita lang. Hindi nya ginagawa mga sinasabi nya.

Atty. tinanggap na po ng boss ko resignation ko.  Tinatanong nya po kung magkano aabot ang 13th month pay ko. Pano po ba ang bilang ng months for 13th month pay computation? Feb.17,2014 po ako nagstart then last day ko is Sept.15,2014. Kulang po ng one day para maging 7 months. 6 months po ba or 6.5 months? or pwedeng 7 months na?

Months = 7

Computation = Basic x 7/12

one more question pa po pala. kelan po inimplement sa labor code yung basta naka-one month ka sa job mo entitled ka na sa 13th month pay pro-rated? meron po kasing nagsasabi na dapat daw naka-one year muna bago makakuha ng 13th month pay.

Such employees are entitled to the benefit regardless of their designation or employment status, and irrespective of the method by which their wages are paid, provided that they have worked for at least one (1) month during a calendar year.

Hi Everyone, I just would like to ask about immediate resignation and one month notice to employer. Kapag nad tender po ba ako ng resignation and there is a notice of one month (notice to resign today, September 8, effective Oct. Cool, but the employer would like me to have an immediate resignation, does it mean na dapat sa last pay ko bayad ako until October 8 kahit ginawang effective ng employer ko ang resignation on Sept. 8? are they violating any labor laws kapag hindi nila binigay yung past pay ko covering until Oct. 8? My contract btw, states that I need to render one month notice.

Thank you in advance and badly need your advice too.

If they do not require you to render, then you leave immediately. End of story.

I do not see why they should pay you until Oct 8 if you are not reporting for work - except if they say clearly that they will pay you for those days.

Gud am po ask ko lang... Gusto ko po kasi magfile ng immediate resignation yun ndi ko na tapusin yun 30days... Ang reason is pinapagawa ako ng company ng illegal against my will at pinagagawa ng trabaho na ndi ko nmn trabaho. Pag ganon po ba maidedemanda pa ba nila ako at kailangan ko pa po ba bayaran yun bond n nakalagay sa contract. Open contract nmn po ako

napakatagal na po pala. nakakalungkot namang isipin na hindi alam ng mga negosyante or hindi sinusunod ng mga negosyante ang batas na yan. ang alam po ng karamihan, mabibigyan ka lang ng 13th month pay kapag umabot ka sa company sa month of december. dun ka lang mabibigyan ng 13th month. pero kung sakaling matapos ang contract mong wala pang december goodbye na rin sa 13th month.

Hi Atty.

i need your advice. i resign from my employeer and i stated in my resignation that is irrevocable. prior to that i already inform the hr i want to resign becoz yung supervisor hindi ko matake yung attitude na kahit na im trying 2 be professional pero xa umasta parang sino den i just found out that prior to me who has the same position as i am ay nag.AWOL. then after the talk with HR they transfer me to another supervisor but still yung workload ay galing sa ex supervisor ko den same pain. after 2 weeks or more from my resignation i received a letter telling me to explain why since ang nakasaad sa contract is 1 mo. notice if i violated i have to 500k. i need your advice atty on what shoud be my proper reply for this.

i guess pananakot eto sa ex supervisor ko kasi sa dami buh namn nagresign at nag-awol ako lang ang hinabol nya. then i heard from my officemate that she was so mad & said that they should file a case against me which is to personal. nagalit xa sa aking kasi alam nang top management yung being unprofessional nya at sabi nang HR sa akin aware daw yung management den hindi rin maganda ang evulation nya.

Hi, Atty.!

Hoping to get your legal advice on some questions:

1) Are employers compelled to accept resignation?
         - My immediate manager has always been away on business trips and I have tendered my resignation beginning Sep. 1 until Oct. 1 but he hasn't signed the letter yet. The company insists that the 30-day notice will count on the day the letter has been accepted. Now, it's not really my fault he's always away or choose to ignore the letter (I could only guess). A copy of the letter has also been submitted to HR Dept.

2) Are electronic resignations acceptable (via email)?
        - A copy of the letter has been sent to my immediate manager's email (same day I filed my letter) to ensure it gets to him copying the head of HR. I got a reply from HR Head which means the email has been received.

I am looking to start a new role with a new employer soon and I need this sorted out. Your help is much appreciated.
