Good day mga sir and madam,
Gusto ko lang po mag tanong, Im planning to buy a car (lease po ito,bank financing) , however natatakot kami na baka mag habol ang aking "ex-wife", here are the facts:
1. malapit na po ako mag file ng annulment case dahil i caught her cheating not just w/ 1 person, over the span of 4 years
2. nagkipag hiwalay ako nung nov 2013 and nag pa notarize ako ng document (signed by both parties) na since nov 2013 eh hindi na siya nakatira dito sa bahay namin
3. my mom will be a signed co-owner of the car
4. ung kukunin po naming car will be payed monthly thru direct debit via a bank account under my mom's name
5. ung registration ng car will be under my name dahil ako ung na approve for a car loan sa bank
**being said, here are my questions po:
1. may habol po ba ung ex-wife ko since may notarized document kami na nag sasabi na we are living separately since nov 2013?
2. since co -owner ko ang mom ko and pag naging greedy ang ex-wife ko eh magiging ang magiging hatian po ba ay 25%(mine)/25%(ex-wife)/50%(mom)?
3. totoo po ba na since lease ito ay hindi ito considered as marital asset dahil its a liability so hindi po ito idedeclare pag nag file ako ng annulment?
4. kung mom ko ang mag babayad ng car, even though nasa pangalan ko ung registration ay pwede ba ito ipaglaban na wala karapatan si ex-wife dito?(especially na ung payments will be coming from my mom's bank account)
