gud day! my niece is 13years old,she is studying at the time the incident happened. she was texting a 21 year old guy and they had sex just for once..after 6 mos we discovered she was already pregnant..can we file a case against the guy knowing that the girl is only 13?

That is definitely statutory rape! Report it ASAP to DSWD and file a police report.
