Hi Atty,

Dumadaan po ako everyday sa Greenfield Parkway (greenfield exit in SLEX) sa Laguna. Bago ako makadaan sa area na yan kailangan ko magpurchase ng sticker sa Greenfield kasi property po yun ng Greenfield.

Nung lastweek po, habang nagdrive ako may mga baka na biglang tumawid. Nabangga ko po yung isang baka at malaki po ang damage sa sasakyan ko kasi malaki po yung baka. Wala pong nangyari sa baka. Sabi ng OIC kaya may baka kasi nasira po yung bakod dahil sa bagyo.

Nagfile po ako ng complain sa greenfield. Ang sagot po nila sa akin ay hindi nila liability iyon.

Kinausap po namin ang may ari ng baka. Sabi nya walang kasalanan ang baka.

Tama po ba yun? Hindi po ba liable ang Greenfield na company kasi nagbayad po ako para makadaan duon sa area nila at dapat e secure nila ang property ng maayos na walang makakadisgrasya sa mga motorista? May mga guard po doon sa area. Nakausap ko nga yung OIC, sabi nya may lapses sila pero hindi liable ang Greenfield. Dapat yung may ari ng baka.

Hoping for your response and guidance po. Kasi malaki po damage sa sasakyan ko at mahal po magpaayos ng sasakyan. T

di po ako atty pero kung dahil nga sa bagyo, nakawala yung baka, absuwelto sila... UNLESS... you can prove na AFTER lumipas ng bagyo at di pa rin nila inayos ang kanilang bakod at hinayaan nilang patuloy-tuloy na nag-s-stroll ang baka around the subdivision, ibang usapan yan.

law on torts will apply and you need to prove NEGLIGENCE on their part para maging liable sila. kasuhan mo si subdivision at yung may-ari ng baka ^^

Article 2176. Whoever by act or omission causes damage to another, there being fault or negligence, is obliged to pay for the damage done. Such fault or negligence, if there is no pre-existing contractual relation between the parties, is called a quasi-delict and is governed by the provisions of this Chapter. (1902a)
