Going back to Holy Week 2014 I was arrested on a ridiculous case of theft and, within 24 hours of being arrested the complainant dropped the case against me except that the corrupt police tricked him (his words, not mine) in to signing papers that he was proceeding with the case against.
The complainant subsequently returned to his home country on the other side of the world believing that he had dropped the case however the corrupt police filed the papers that they had tricked him in to signing with the court and the case is continuing ... without a complainant!
When I was arrested I was read my rights that included my right to remain silent and that the Philippines government would provide and pay for an attorney to represent me ... But the case became dropped before I even got to see any attorney.
Well some weeks back the police attempted to serve upon me court papers that I was required to sign for, I quoted to the policeman my rights (to remain silent/ a provided/paid for attorney) and as far as I'm concerned my rights include that I don't sign for anything until I have seen my provided/paid for attorney.
Then three days ago the postman attempted to deliver "signed for" court papers, not just for me but for the complainant also (c/o my address), I declined delivery of my papers whilst I told the postman to "return to sender" the papers for the complainant.
Now, no doubt, those papers were notices for both of us to attend court on X date, as I say I'm maintaining my right to remain silent which I interpret as not signing for anything either so my question is "what is likely to happen next?"
I, nor the complainant, are going to be attending court at a date/time that we have no knowledge of so are the court likely to instruct the police to arrest me for not attending court or might the court just realise that, with neither the complainant nor the detendant attending, there isn't a case to be answered to?
