Good evening, I would like to raise my concerns on my previous employer. Last March 30 I have submitted my resignation letter and was received by my former bosses and our HR department. On April 30 which was the effective date of my resignation I have already turned over all documents, company assets and made my endorsements to my replacement on other items that still needs to be addressed since I will no longer be connected to the company.
My problem started on my last day, I was approached by my boss and said that she will not be signing my clearance because she requires one of my client to sign their contract before she can endorse my clearance(the contract was a sales contract and was already processed for clients review). I protested stating that the clients signature was already beyond my control. I have already done all the necessary requests and endorsements to have the draft contract processed but to have the signed contract as part of the requirement is unacceptable. besides I am no longer authorized to represent the company because i have tendered my resignation.
We had a heated argument at that time since she kept insisting that this was her requirement. I have escalated this to our HR department and actually they themselves were saying that what she demands is unacceptable. I was given the assurance that they will be the one's to process my clearance since it is part of their duty.
Unfortunately it has been more than three months since I resigned from Maxicare. I have been constantly making follow ups with our HR department but they kept telling me that it was still on process. I have only received their update last friday when I called their HR manager and he informed me that my former boss is still holding her clearance because of her requirement which was the signed contract of the client.
I really cant see the point in this, it seems to me that this is being done deliberately and this has been a big hassle on my part.
Can I file a complaint against my former boss? I have documents to prove that I gave a proper turn over before I resigned. I have also documents of my email complaint to our HR department. Or may I know what are the legal actions that I can take to resolve my problem?
