Breach of Contract

Just wanna ask for advice. May napirmahan kasi akong Non Disclosure Aggreement w/ my current employer. Enclosed dun na bawal magdivulge ng mga confidential information, other side-line works. And bawal mag-apply to competitors, suppliers, & customers not after 1 year of termination.

Now, Im probationary pa naman, and iniisip ko ng magresign.  I've got a chance to a big company, na supplier pala nila. I'm very much eager to get hired on that company. So wala ba kong ibang way para di ma-breach of contract?

your last hope will be your company you are connected with. you should ask their written consent before you could transfer to their supplier-company. the NDA is binding whether your a probee or a regular.

Sir, ganito po kasi yon nung 2008 may gf po ako. siya po ay mas matanda sakin at may mga anak na. Nung time na yun nag apply kami sa isang immigration services agency na papunta ng canada as common-law partners kumbaga. So kasama sa application namin ay ang mga anak nya din. Ang occupation ko po nung time na yon ay accountant at siya naman ay sa call center agent. Kaya nung magpa assess kami pasado sa criteria at nag pirma na kami ng contract para ipa process na po yung papers namin which nagbayad yung gf ko ng 5thousand if i'm not mistaken. Ngayon nung taon din yon after 5 months nagsara po yung company na pinapasokan ko kaya napilitan akong mag saudi. Nung nasa saudi ako, bago matapos na ang contract ko naghiwalay na kami ng gf ko kaya di na namin natuloy yung plano. Sa ngayon po ako ay may asawa na at wala na ako balita sa kanya pero may nakapagsabi na nasa U.S. na daw siya sa kapatid niya. Ngayon po hingi po sana ako ng advice kasi nag email sakin ang agency ng ganito po....“COUNSEL shall exercise reasonable efforts to notify APPLICANT of the status of his immigration application to Canada. In the event of inaction by APPLICANT after the execution of this agreement, COUNSEL should contact the APPLICANT by telephone. After reasonable efforts by telephone, COUNSEL shall send APPLICANT two (2) written notices delivered by registered mails. If no written response is received within 45 days from the date of the second written notice, this agreement is deemed breach. It is mutually understood and agreed that in such occurrence, APPLICANT is no longer interested, and that COUNSEL is rid of all legal obligations pertaining to do this agreement, and APPLICANT shall remit the full balance of the consulting fees to COUNSEL. In this case, COUNSEL reserves the right to act, as PLAINTIFF in any debt recovery proceedings against the APPLICANT, and APPLICANT shall be liable for any legal fees incurred of any legal action to collect payments by COUNSEL.”...tanong ko po..pwede ko po bang hindi ipagpatuloy ang contract kasi d naman kami magkasama? at anu po bang payments na sinasabi ng agency kasi hinde naman ma submit ang papers namin kasi incomplete at saka naghiwalay na kami....sana po matulungan nyo ako sa kaso ko...thank you po..more power.
