CHILD's SURNAME - ILLEGITIMATE

Hi, ask ko lng po kasi ung friend ko nagkaron po sya ng anak out of wedlock. He was abroad nung nanganak ung child's mother and hindi sya ung nagsign sa birth certificate nung bata. So now one year old na ung bata and ung gamit ung surname nya pero binawalan na ung friend ko puntahan o makita ung bata. This is because the child's mother died after 3 months napanganak ung bata and the family of the mother hate my friend. Di sya pinapapunta sa bahay to see the child and wala na connection for a year. Pero now my friend wants to change the child's surname para mawala na ung surname nya na dinadala ngayon ng bata. Pano po ito ggawin? And how much po ito palitan? Ano po ung mga requirements? How long will it take to process? Thanks. Please help...

An illegitimate child is allowed to use the surname of the father. Bakit ayaw nyang pagamit ang surname nya?

Kasi po ayaw naman ipakita sa kanya ung bata, inayos na sa DSWD ung issue regarding this na hindi na po sya allowed to see the child eh. Kasi sabi nung family na magaasawa lang din naman po sya so wag na nya kunin ung bata. He wants to do this para mawala na ung connection nya sa family na yun. Ano po ba ang process regarding this issue? Pwede po ba yung gusto nya na alisin surname nya? Salamat po.

Pwede magpetition for change of name, alleging that he never acknowledged paternity over the child. Pero kawawa naman yung bata. Anyways, it's your call. Good luck

Yes, more or less. Kailangan kasi may court order pa bago mapalitan. So may hearing pa yan at you will need a lawyer pa.

So kahit na hindi sya ung nagpirma sa birth certificate and all that, need pa umabot sa court? Is that the only way Atty. to remove his surname to the child's name?

Yes, because all entries in the certificate of birth are presumed correct. Hindi basta basta mapapalitan.

Just wondering lng po Atty. if what's the difference kasi nung when I was born, iba ung nalagay na first name sakin. And my parents decided to change it pero mabilis lng po at wala nman court hearing etc.. I think they only paid 5,000max para mapalitan lang sa birth certificate. Baka po correction lang ang sinasabi nyo. Administrative lang po ang correction, civil registrar lang po ang magaapprove.
