Hi po, meron kasi ako friend na nangangailangan ng tulong for legal advise regarding on the estafa case file by his boss against him.Sabi po nya, naka received sya ng subpoena, kaya he really want to settle sna personally sa boss nya para i proposed ung arrangement ng payment sa funds na misappropriated nya. Kaya lang, natatakot sya baka mali sa batas ang magiging move nya. Mahal daw po ba kumuha ng abogado kasi di nya kaya mag hire ng abogado. Hope maliwanagan kami sa kanyang hinihiling tulong sa inyo.

estafa can be settled so he should not be afraid to propose settlement of the civil damages of the case. just don't admit that he committed misappropriation. he should attend the hearing and make his proposal. if it is not accepted, then he should prepare his counter affidavit, and present his own evidence. i always recommend to get a lawyer. doing so, he proceeds at his own risk.

Thank you po. Ask lang din po kc he emailed that he admitted already for the misappropriation kaya nga daw po magpo proposed sya ng settlement para hindi na sila mag usap pa sa hearing. Kilangan daw po ba sa unang hearing sa fiscal may abogado na sya agad.

not necessary that he has a lawyer immediately. but he cannot disregard the hearing. it is now up to the fiscal what to do with the case. good luck.
