Good morning,

I would like to seek advice regarding my plans to terminate my employment from current employer.

1. I need to resign immediately (1-week notice). Is this allowed in special circumstances?

2. My contract says we just need to advise the company (with no written specific duration) in case we need to resign.

1. Allowed only if employer approves.
2. The Labor Code will still be followed - 30 days.

My relationship with my current supervisor has been sour.

So much so that she has no plans for my career development in the company. (we remain civil with each other though)

I found a company that is willing to offer a job for me but they require me to start immediately.

That's a matter of opinion. But might not hold.


Reasons allowed:

An employee may put an end to the relationship without serving any notice on the employer for any of the following just causes:

1. Serious insult by the employer or his representative on the honor and person of the employee;
2. Inhuman and unbearable treatment accorded the employee by the employer or his representative;

3. Commission of a crime or offense by the employer or his representative against the person of the employee or any of the immediate members of his family; and

4. Other causes analogous to any of the foregoing.

Your liability for non-compliance? Check the contract. If silent, then the courts may be needed to determine it.

Alright. So clearly, this will put me in big jeopardy.

The only way I can escape this is to convince them to sign my resignation and acknowledge receipt of it?

Convincing them to sign is one side.
Acknowledgment or receiving is only part of it.

APPROVAL is the other part.

If I can follow up, what "liabilities" or "damage" can the employer level against me?
