Ano po ba ang steps ng Due Process? Kung isa sa mga steps eh hindi nagawa, pwede ba i-complain yun sa DOLE? Halimbawa, na-terminate pero hindi nagawa ang tamang Due Process...

Vane, may notice, may decision, pero walang hearing, acceptable po ba yun?

Binigyan nila ako ng IR on Feb 14, 2014.. Nagbigay ako ng written explanation on Feb. 15, 2014. Sabi nila may hearing pa. Pero hindi na nagkaroon ng hearing. Feb. 20, 2014, bnigyan ako ng dismissal memo, terminated na daw ako.

I filed grievance pero hanggang ngayon wala pa din ako balita sa ni-file ko, its been almost 2 months na.

Nag-complain ako sa DOLE, binigyan ako ng SeNa nung April 25, 2014. During SeNa sa DOLE, pinagtawanan lang ako ng attorney ng company ko, sabi eh ganun daw talaga ang patakaran ng company ko na yung written expalanation eh katumbas na daw yun ng written explanation. Hindi kami nagka-ayos during SeNa. Sabi ng mediator ng DOLE, mag-file na lang ako ng complain sa DOLE kasi hindi kami nagka-ayos during SeNa. Kung ipagpapatuloy ko yung complain ko, may laban ba talaga ako?

I mean, yung written explanation ko daw eh katumbas na daw yun ng hearing.

The procedure for terminating an employee is found in Book VI, Rule I, Section 2(d) of the Omnibus Rules Implementing the Labor Code:

Standards of due process: requirements of notice. – In all cases of termination of employment, the following standards of due process shall be substantially observed:

I. For termination of employment based on just causes as defined in Article 282 of the Code:

(a) A written notice served on the employee specifying the ground or grounds for termination, and giving to said employee reasonable opportunity within which to explain his side;

(b) A hearing or conference during which the employee concerned, with the assistance of counsel if the employee so desires, is given opportunity to respond to the charge, present his evidence or rebut the evidence presented against him; and

(c) A written notice of termination served on the employee indicating that upon due consideration of all the circumstances, grounds have been established to justify his termination.

So, ibig po ba sabihin niyan, may laban po ako sa DOLE?

Nung nag-SeNa po kasi kami, pinipilit ko na mali yung Due Process kasi walang hearing na nangyari. Pero tinawanan lang po ako ng Attorney ng company ko at yung DOLE representative. Para silang magkakilala kasi nagkamustahan pa sila.

Hindi kami nagka-ayos during SeNa kasi ayaw makipag-ayos nung attorney ng company ko. Gusto ko i-derecho ng complaint. Natakot lang ako na baka matalo ako sa kaso.

Nabasa ko po sa binigay niyong link na may "termination JUST CAUSE" and "termination by AUTHORIZED CAUSE". Ano po difference nun?

Ganito po kasi nangyari: 2009 na-employed ako sa ABC company ko. Hanggang training lang natapos ko kasi nag-AWOL ako.

Jan 2014, I received a call from that company at gusto daw ako i-interview for possible work. Pumunta ako sa company na yun, sa Resume ko hindi ko ni-declare sa working experience ko yung ABC Company kasi hindi ko naman natapos yung training so sa tingin ko useless lang. Pero before the interview, sinabi ko sa HR na galing na ko sa ABC Company. Sabi nung nag-assist sakin na ok lang daw yun, ilagay ko na lang daw yung #2 sa profile ko. WHich I did.

Na-hire ako. Nag-training for 1 month. Kinabukasan, Feb 14 2014, nag-uumpisa na kami sumabak sa floor pero bigla ako nakatanggap ng IR/DPF for Possible Falsification of Documents. Feb 15 2014, I gave my written explanation. Sabi nila hintayin ko na lang daw ang hearing. Feb 20 2014, bigla ako nakatanggap ng Termination Notice.

Wala man lang nangyari na Hearing.

I filed grievance kasi ang unfair ng nangyari. Pero 3 months na yet wala pa din ako balita. So nag-complain na ko sa DOLE.

Apr 21, nag-SeNa kami, pero pinagtawanan lang ako ng attorney at yung DOLE rep, sabi eh yung written explanation eh katumbas na ng hearing. Sabi ko, yung taong pumatay nga eh, inamin na niya na siya pumatay, pero dumaan pa din sa tamang process, may Hearing na nangyari.

May point po ba ako? May laban ba talaga ako pag derecho complaint ako?

Ako po yung asawa ng may-ari ng account na eto. Ginamit ko lang itong account niya para maka-hingi ng advice. Pinuntahan ko na ang HR pero wala silang maibigay na rason or whatever. Binabalewala lang nila reklamo ko. Time is running. May anak ako na binubuhay ko. Naapektuhan anak ko dito.

Sure you can file a complaint but I doubt that it will amount to much.

As you said you filed for grievance and nakausap mo na ang HR - sino doon? Kahit anong result nyan, siguradong ibibigay sa iyo ang sagot basta personal mo silang makausap.
