HELP! Our TRAINING was held in a BUILDING UNDER CONSTRUCTION

Legal Advice Please. Thanks in Advance.


According to the latest survey, this company that I am referring to is the 4th richest BPO company in the Philippines.

The company transferred us to another account that is why we have to undergo another training. The training was held in an old building in Makati. The said building is under renovation at that time.

Surprisingly, they've let us train inside the building while it is under renovation. The construction workers are actually painting, building blocks, mixing cement, etc while we are training inside the training rooms. Most of us got cough and colds. We were not able to get any medical certificates. On the other hand I got an eye wound because of a foreign object that got into my eye during training. I have a medical certificate for that but no proof that the foreign object came from the construction. I took pictures of the construction workers working while we are inside the building. Can I still file a case even if it happened 1 moth ago?

- and can a company also make you work for 6 consecutive days?

You can claim for ECC but the 6 consecutive days are standard workings days. What's the problem with that?

What is ECC? Where should I claim it? What are the steps that I have to take to pursue my complaint because now my eyes are suffering but even if my eyes were not suffering can I still file a case just simply because they made us work in a dangerous environment? Can you give me an article for that mam/sir?

With regards to the 6 consecutive days of work, on other companies that I have worked with they will ask us to sign something first before we can have working shifts for 6 days but this company did not make us sign any. We used to work 5days a week.

To answer your concern about a 6-day shift:

ART. 91. Right to weekly rest day. - (a) It shall be the duty of every employer, whether operating for profit or not, to provide each of his employees a rest period of not less than twenty-four (24) consecutive hours after every six (6) consecutive normal work days.

So far the company is complying with standards set forth in the LC.

Thanks a lot. How about my concern about the building under renovation sir? Can I file a case against them? Because I cannot prove that the reason why I had the eye wound is because of the construction. Can I just file a complaint because the working place is dangerous to their employees health?

"Case" involves courts, baranggay or other similar avenues. Not a good option. What if you win?

Try raising the concern to your supervisor/manager then HR and Administration of your company.
